<br /> <br /> <br />Representative: Stephen Sparn, Principal Architect <br /> <br />Public Notice Verification: Paul Wood, Planning Director, reported that public notice was properly served <br />having been published in the Daily Camera, posted in City Hall and mailed to the surrounding property <br />owners. <br /> <br />Disclosures: Chris Leh is excused for this agenda item. <br /> <br />Staff Report of Facts and Issues: Wood reported the addition of eight (8) emails to be entered into the <br />record from Jim Gavic, Nancy Lee, Bradley Chronowski, Nancy Lee, Nancy Lee, Stephen Sparn, Stephen <br />Sparn and Forwarded reply. Kalish moved they be entered into public record. Seconded by McAvinew. <br />Motion passed by voice consent. <br /> <br />Wood reported that the applicant and owner, JoBelle Fischer, represented by Stephen Sparn is requesting <br />authorization of a Final Subdivision Plat and Final PUD development plan for the platting of nine lots for <br />single family detached homes. Eight of the lots are for new residences and the ninth lot is the existing home <br />site. The Preliminary Subdivision Plat and PUD development plan was approved on June 12, 2001, <br />Resolution No. 17, Series 2001 with five conditions. <br /> <br />Wood reported that the Phase I Environmental Report for the property was submitted on July 18, 2001. <br />The assessment concluded that there were no historical recognized environment conditions. The report <br />recommends the abatement of potential asbestos-containing materials found in the exterior of the one-care <br />garage on site, the removal of numerous containers and barrels labeled as having contained oil, concrete <br />mixtures, and paints and the five storage tanks which formerly had contained petroleum products be <br />removed. Staff recommends that prior to the issuance of an overlot grading permit that the applicant be <br />required to certify completion of all recommended abatement actions. <br /> <br />The grading plan reflects an overlot grading proposal for the entire parcel. The grading plan has been <br />revised to provide a more gradual transition between Parcel A and the adjoining residential lots to the east. <br />A series of retaining walls have been eliminated based upon such revisions. The Parks Department has <br />reviewed and approved the grading plan as modified in the September 4, 2001 letter from Keim and <br />Associates to Craig Kitzman. Staff would recommend the applicant modify the final grading and drainage <br />plan per plan approval prior to review by City Council. <br /> <br />Wood reported that a site visit by Mr. Mayhoffer, the applicant and staff walked the property on July 25, <br />2001 with the purpose to evaluate the Mayhoffer Ditch along the north property line in light of referral <br />comments received from Mr. Mayhoffer. Those comments raised issue with the amount of vegetation in and <br />along side of the ditch, which raised conflicts with ditch flows and access. <br /> <br />Staff and the applicant agreed on three tree service companies which have provided estimates for the cost of <br />completing work along both the north and west property boundaries. All three estimates were within the <br />range of $15,000 and $16,000 with approximately half of the cost allocated to each of the two property <br />boundaries. <br /> <br />Staff would recommend that the applicant play the full cost of Parcel maintenance prior to dedication of the <br />parcel to the City. <br /> <br />Wood reported that the revised PUD has provided a detail of the proposed fencing plan which staff <br />supports. <br /> <br />3 <br /> <br />
