Motion <br />passed. <br /> <br /> <br /> <br />Resolution No. 25, Series 2001, <br />Hoyle Zoning, a request to zone a 33.78-acre parcel on the <br /> <br /> <br />north side of Dillon Road, approximately 800 feet east of South Pierce Ave. and if annexed <br />into the City of Louisville to be known as the Hoyle Annexation. Case #00-053-AX/ZN. <br /> <br /> <br /> <br /> <br />Applicants: Virginia Hoyle & Ira Kenneth Hoyle Family Trust <br /> <br /> <br />Representative: Richard V. Lopez <br /> <br />Public Notice Verification: Ken Johnstone, Principal Planner, reported that public notice was properly <br />served having been published in the Daily Camera, posted in City Hall and mailed to the surrounding <br />property owners. <br /> <br />Staff Report of Facts and Issues: Johnstone reported that the applicant is requesting to zone a 40-acre <br />parcel of property currently under consideration for annexation to the City as Industrial (I). The parcel <br />is zoned and used agriculturally in Boulder County. The property is known as the Hoyle Property and <br />th <br />is located on the north side of Dillon Rd. approximately midway between Pierce Ave. and South 104 <br />St. Along the east property line there is a separate 4-arce parcel also zoned agriculturally. The larger <br />parcel to the east is undeveloped property zoned industrial within the City of Louisville. To the north <br />and northwest are platted lots within CTC First Filing. To the southwest is property known to the <br />Commission as Dillon Center, recently approved for a small industrial project by the Commission and <br />City Council. To the south, across Dillon Road is City/County open space that was recently <br />disconnected from Louisville and is now part of unincorporated Boulder County. The Hoyle Property <br />is affected by an intergovernmental agreement (IGA) known as the Southeast Boulder County, South <br />th <br />96 Street, Dillon Road and US 287 Comprehensive Development Plan (Plan). The Hoyle Property <br />was designated as one of several “Rural Preservation Area Parcels”. Rural preservation parcels are <br />intended to be maintained as either agricultural or estate residential under existing Boulder County <br />regulations. Such parcels cannot be annexed into any of the municipalities subject to the agreement, <br />unless all parties to the IGA (through an IGA amendment) authorize such annexation. <br /> <br />The Planning Commission is considering only the zoning portion of the annexation/zoning request. <br />The Commission is required to make a recommendation on the zoning of the property to the City <br />Council. The initial zoning of property is required to be reasonable and based on the goals and policies <br />of the City as outlined in the City’s Comprehensive Development plan. <br /> <br />Johnstone reported that Staff is recommending disapproval of the request for Industrial zoning. Staff <br />found the requested zoning to be inconsistent with the City’s Comprehensive Plan for this area, which <br />established the property as a Rural Preservation parcel, not eligible for annexation into the City without <br />th <br />authorization of all other parties to the Southeast Boulder County, South 96 Street, Dillon Road and <br />US 287 Comprehensive Development Plan. Further, the terms of the Rural Preservation designation <br />would make an Agricultural zoning designation the only appropriate City zoning designation. <br /> <br />Commission Questions: None. <br /> <br />Applicant Presentation: Richard V.
