Staff Public Notice Certification: Paul Wood, Planning Director, certified that public notice was published in the Louisville Times on Wednesday February 3, 1999, mailed to surrounding property owners on February 3, 1999, and posted in City Hall. All Planning Commissioners verified that they were familiar with the site. Staff Report of Facts and Issues: Paul Wood presented the details of this matter as stated in the staff report. Mr. Wood read into the record a letter from the applicant received on February 18, 1999, withdrawing any request for Special Review Use approval at the Planning Commission hearing on this date. Mr. Wood stated that if the applicant does desire to incorporate Special Review Uses into this PUD approval, that would be necessary to advertise for that at a final hearing before the Planning Commission. Chairman Boulet moved that the Commission exclude consideration of Special Review Uses for this proposal at this hearing. Seconded by Jeffrey Lipton. Unanimous voice vote in favor. Mr. Lee’s letter of February 18, 1999, was entered into the record. Paul Wood stated that staff is recommending denial of this application at this time. Commission Questions: None. Applicant Presentation: Bob West with Oz Architecture, 2336 Pearl Street, Boulder, CO representing Jim Vasbinder with Etkin Johnson and Jon Lee with the Colorado Tech Land Company. Mr. West stated that they have some disagreements with Staff comments regarding the City Council meeting and how they were perceived on this project. Mr. West introduced a 3-D CAD model of the Business Center at CTC with concepts of buildings and explained their intentions to the Planning Commission. Mr. West stated that they have increased landscaping substantially from the original proposal and have tried to add screening. Mr. West stated that they have provided the landscaping to the entrances to the site per the PUD, and now are being told that it is inappropriate. Mr. West indicated that they are following the overlay PUD and they have some disagreements with Staff regarding certain issues. Mr. West asked for the Commission’s direction on some of the big issues so that they can move forward with their comments. Mr. Lee is not sure if this should be a Preliminary or a Final PUD and would like to have that reflected on the record. Mr. Lee feels that they have offered a solution to try to solve the problem of separating the water from Maple Grove and are now waiting for a response from the City.
