Therefore, Staff forwards a resolution (No.13) of disapproval of a Preliminary PUD <br />Development Plan and a Preliminary Replat to Planning Commission with findings 2, 3, 4 and 5, <br />with the understanding that any reference to a SRU action or Condition No. 1 be stricken from <br />the resolution. <br /> <br />Applicant Summary: <br /> <br />Jon Lee addressed the approved PCZD plan which says that this area, including Special Review <br />Uses shall be Industrial Design Guidelines. It shall be Commercial Design Guidelines if it’s office. <br /> Mr. Lee feels that they should be dealing with Industrial Design Guidelines, however they are not <br />available at this time. Mr. Lee is unclear as to what standards they are to be following. <br /> <br />Public Hearing Closed/Commission Comments: <br /> <br />Commissioner Pritchard is in favor of giving the Staff and the applicant the opportunity to try to <br />work this out. <br /> <br />Commissioner Klahn is doubtful at this point that they would be able to come with something that <br />is solid. <br /> <br />Commissioner Lipton would also favor a continuance. He would also like to see some major <br />progress made, especially on the architecture. <br /> <br />Motion made by Commissioner Klahn to approve Resolution No. 13, Series 1999, which is a <br />resolution disapproving the Preliminary PUD Development Plan and Preliminary Replat for lots 2, <br />3, 4, 5 and 6, Block 7, The Business Center At CTC. Chairman Boulet suggested that all <br />reference to the Special Review Use within that motion be stricken. Commissioner Klahn added <br />that with the additional basis No. 1 being that the applicant has not effectively addressed the <br />issues regarding sidewalks and design issues pursuant to the PUD ordinance. <br /> <br />Commissioner Lipton added a friendly amendment to state it as saying “Adequate provisions must <br />made for a pedestrian walks, malls and landscaped places to prevent pedestrian use of vehicular <br />ways.” Accepted by Sarah Klahn. The remainder of the conditions remain as suggested in the <br />Staff motion. <br /> <br />Seconded by Robert McAllister. <br /> <br />Commissioner Lipton asked Paul Wood to incorporate a parking condition. <br /> <br />Paul Wood stated that there is enough parking on this lot to park 100% office and to the extent <br />that this would compromise landscaping of 25% there is some concern as to how it will be <br />administered. The concern is that the smaller building may be taken out and then there will be <br />two detention ponds and a huge parking lot. <br /> <br /> 8 <br /> <br />
