Public Hearing Remains Open/Commission Comments and Vote:

Chairman Boulet stated that the hearing will remain open and that it will be continued to May 11,
1999, and be resumed and concluded at that time.

Motion made by Jeff Lipton to continue Resolution No. 18, Series 1999, to the May 11, 1999,
meeting. Seconded by Robert McAllister.

Unanimous voice vote to continue to May 11, 1999.

E. Resolution No. 22, Series 1999, Reconsideration of American Variseal Final
PUD and Final Replat on Lots 3 and 4, Block 1, The Park at CTC.

Staff Certification/Planning Commission Disclosures:

Ken Johnstone informed the Commission that this application was heard by City Council on April
6, 1999. City Council then referred this application back to the Planning Commission for further
consideration. Notice was not required. All Planning Commissioners disclosed that they are
familiar with the site.

Staff Report:

Ken Johnstone stated that this Final PUD application was heard by the Planning Commission on
January 12, 1999, and at the public hearing the Commission failed to recommend approval but did
forward the application on to City Council with a negative vote on a resolution that recommended
approval. The primary issue of concern that evening was the proposed metal siding on the center
element (referred to as the spine of the building) and whether that was an appropriate material.
Given the amount of it the Commission questioned whether it was truly an accent material or
rather a primary material. Council agreed that the metal siding was an issue and referred this back
to Planning Commission with their comments. Mr. Johnstone presented the details of this matter
as stated in the staff report.

Commission Questions:

None.

Applicant Presentation:

Steven Walsh, Architect with RNL Design, representing American Variseal. Mr. Walsh stated
that his client has instructed him to make the changes necessary to gain approval. They have
replaced the metal siding with a stucco spine. All other architectural issues on the conditions of
approval they agree with and have no further requests at this time.

5
