Johnstone continued with a discussion of lots that are considered ‘legally non-conforming’ and <br />how that can regulate whether existing lots are either allowed to further split or conversely, <br />consider adjacent parcels to be effectively combines. Based on an inquiry by the owners to the <br />Planning Department at time of purchase in 1998 they received a letter from a former staff <br />member. The letter referenced Section 16.12.120 of the Louisville Municipal Code, which states <br />the following: ‘In the event that as of January 1, 1982, a lot exists within the city on which two <br />or more complete living units with separate utility service are located, the property owner may <br />apply for a subdivision of such lot, even though the lots created would not meet the requirements <br />of this title. In granting a subdivision under this section, the property owner must obtain separate <br />water meters for each lot created. A subdivision under this section may be created under the <br />minor subdivision process as set forth in section 16.12.110.’ <br /> <br />Johnstone stated that the property owner has provided documentation that the two structures <br />have separate accounts for utilities. One utility issue that came up during the staff referral <br />process pertains to sanitary sewer service for 537 Lincoln Ave. Based on City sewer line videos, <br />there are clearly two sanitary taps, however it appeared one may have been abandoned. Based <br />on further field research, it was confirmed that the sewer service for 537 has been combined into <br />the sewer service for 533 Lincoln, rather than each having a direct connection to the public <br />sanitary sewer line in the street.
