DRAFT <br />The Ordinance was drafted by the Historic Preservation Commission and City Staff in <br /> <br /> <br />the City Manager’s Office. <br />The Historic Preservation Ordinance would become a Chapter of Title 15 of the <br /> <br /> <br />Louisville Municipal Code, which pertains to “Buildings and Construction” therefore <br />these regulations will be outside the jurisdiction of the Planning Commission. <br />The majority of the draft ordinance has also been reviewed and edited by the City <br /> <br /> <br />Attorney’s Office. However, the sections related to incentives have been added <br />recently and have not been reviewed by the City Attorney. <br /> <br />Johnstone provided a brief summary of each of the six sections of the proposed Ordinance listed <br />below: <br /> <br />1)Local Landmark Program. <br /> <br />2)Landmarking without Owner’s Consent. <br /> <br />3)Landmark Alteration Certificates. <br /> <br />4)Demolition Permitting. <br /> <br />5)Exemptions for Unsafe or Dangerous Conditions. <br /> <br />Johnstone also noted that some of the incentives related to relief from the zoning code and <br />building code might become amendments to the zoning code, which would require review and <br />recommendation from the Planning Commission before being adopted. <br /> <br />Johnstone reminded the Commission that they are acting in an advisory role in this process. No <br />specific action in a Resolution form is required. The City Council has requested informal <br />comments and direction that the Commission wish to provide. The comments could be <br />forwarded by way of a motion to City Council for their consideration during the public hearing <br />on the Ordinance which is scheduled for early 2005. <br /> <br />Commission Questions of Staff: <br />Loo asked how the Ordinance will mesh with the Comprehensive Plan. <br /> <br />Johnstone stated that as the Ordinance and the Comp Plan move forward that staff needs to <br />review the two for consistency. <br /> <br />Deborski asked how the City will handle the incentives and will these be in place before <br />adoption of the Ordinance. <br /> <br />Johnstone requested that the Preservation Commission address his question during their <br />presentation. <br /> <br />Deborski asked if a fee had been established for the landmarking of property or would be based <br />on an Administrative Approval that had no fee. <br /> <br />Johnstone stated that he is unaware of an established fee for landmarking of property. <br /> <br /> <br />3 <br /> <br /> <br />
