<br />APPROVED – FEBRUARY 10, 2005 <br />Lipton expressed concern with the wording of condition #5 (It may be necessary for the <br />potentially disputed areas on the subdivision plat to be further resolved through the granting of <br />deeds in conjunction with final plat processing. That issue will be further resolved in <br />conjunction with the City Attorney’s office during the final plat processing.) He also stated that the reason for request was to legally subdivide the <br />property for future sale of the lots. <br /> <br />Members of the Public: <br />John Mayhoffer, 10014 Empire Rd, Lafayette requested that the plat identify the irrigation ditch <br />easement along the subject property. <br /> <br />Vlasta Trousil, 195 Continental View Dr, Louisville stated that the ditch easement as identified <br />by Mr. Mayhoffer was correct. <br /> <br />Commission Questions to Staff and Applicant: <br />Lipton asked Johnstone if there was a potential problem with the identification of the ditch <br />easement or could a condition be added to the resolution to resolve the issue. <br />Johnstone stated a condition should be added. <br /> <br />Staff and Applicant Summary and Recommendation: <br />Staff had no additional comments. <br /> <br />Hess requested a clarification from staff and Mayhoffer of the location of the ditch easement. <br />Staff and Mayhoffer confirmed its location along the abandoned railway right-of-way. <br /> <br />Commission Questions: <br />Lipton: None <br />Kalish: None <br />McDermott: None <br />Pritchard: None <br />Loo: None <br />Deborski: None <br /> <br />Public Hearing Closed Commission Comments: <br />11 <br /> <br /> <br />
