Mailed to <br />property owners and posted in City Hall on December 23, 2004. Notice area exceeded the <br />required 500 foot requirement. <br /> <br />Conflict of Interest and Disclosure: None. <br /> <br />Motion to enter into record two emails and one letter. Loo moved and McDermott seconded. <br />Motion passed by unanimous voice vote. <br /> <br />Staff Report of Facts and Issues: Wood provided the following summary points: <br />The request is for an amended final PUD development plan for Centennial Pavilion to <br /> <br /> <br />authorize an existing non-conforming sign for Unit #E at 133 McCaslin Blvd. <br />Original PUD approved by City Council December 2001. <br /> <br /> <br />Signage was allocated to each of the building groups based upon the eligible building <br /> <br /> <br />frontage. <br />The northeast building group, where Lamar Donuts is located has a total of 400 SF of <br /> <br /> <br />signage which is further allocated to individual tenants by requirements specified by <br />the PUD. <br />The PUD allocates 50 SF of sign area and a maximum of two signs per tenant. <br /> <br /> <br />The PUD further designated eligible sign placement and required that no individual <br /> <br /> <br />sign may exceed 25 SF. <br />Tenant finish permit was issued in the Spring of 2003 with a Certificate of Occupancy <br /> <br /> <br />for Unit E being issued on January 22, 2003. <br />A separate sign permit was applied for in December 2003. <br /> <br /> <br />Staff requested a reduction in the sign area as well as modifications to the design of the <br /> <br /> <br />sign. <br />In January 2004 the Planning Division signed off in error on the Building Permit No. <br /> <br /> <br />B03-0339 on January 12, 2004. <br />The installed sign violates the following provisions of the approved PUD: <br /> <br /> <br /> <br />The constructed sign is approximately 42 SF where 25 SF is approved. <br /> <br />The sign includes a back plate between the letters and building, which serves as <br />a raceway. The letters are also mounted to the plate. The PUD requires that the <br />sign be flush mounted to the building and the letters will be individually <br />mounted ‘pan’ channel letters. <br /> <br />The sign letters have a white backlit element which is not consistent with the <br />requirement of the letter to be an individual pan style letter. <br />The PUD is more restrictive then the Commercial Development Design Standards and <br /> <br /> <br />Guidelines (CDDSG). <br />A letter of noncompliance was sent by certified mail on June 2, 2004 requesting that <br /> <br /> <br />the non-conforming sign be removed, or as an alternative that the applicant could <br />proceed to make application for a PUD amendment to request authorization of the sign. <br /> <br />3 <br /> <br /> <br />
