Planning Commission <br />Meeting Minutes <br />NOVEMBER 10, 2005 <br />Page 7 of 12 <br /> <br /> <br /> <br />Staff is recommending approval of Resolution No. 24, Series 2005 with the <br />following 4 conditions of approval: <br /> <br />1)The applicant shall add a note to the final subdivision plat disclosing the fact <br />that the existing structure at 945 Lincoln Avenue (Lot 1A of the proposed <br />Thede Subdivision) encroaches onto proposed Lot 2A. No building permits <br />for new construction shall be issued for either Lot 1A or Lot 2A until the <br />encroachment and applicable setback violations are cured through either <br />relocation or demolition of the existing structure. <br /> <br />2)All existing fences within the subdivision which encroach on public street or <br />alley right of way shall be relocated prior to the issuance of the first building <br />permit on any of the three lots. <br /> <br />3)The applicant shall dedicate on the subdivision plat an additional three (3) feet <br />of easement for public street purposes immediately to the west of proposed <br />Tract ‘A’. <br /> <br />4)The vehicular access to the garage on proposed Lot 2A shall be relocated to <br />come from the rear alley in conjunction with approval of a building permit for <br />any new construction on Lot 2A, with the existing curb cut removed and <br />restored to curb and gutter. <br />Commission Questions of Staff: <br />McAvinew asked if there was a timeline to be followed after the approval of the <br />Variance. <br />Johnstone confirmed that the applicant had six months to apply for the Subdivision Plat <br />after the approval of the Variance. <br />Loo asked if the neighbors had been contacted during the Subdivision Plat process. <br />Johnstone confirmed that the neighbors within a 500’ radius of the property had received <br />written notification of the public hearing. He also stated that no comments had been <br />received during this process but several had supported the request for the Variance <br />because the lots would be more to the size of the neighborhood and the Old Town <br />Overlay Zoning District requirements. <br />Applicant Presentation: <br />Lee Stadele, Flatiron Survey, representing the applicant, discussed the reasoning behind <br />the lot sizes. He also confirmed the applicant’s willingness to comply with the conditions <br />as discussed by Staff. <br />Commission Questions of Applicant: <br />McAvinew asked the applicant, Kevin Thede, if he was in agreement with the conditions. <br />Kevin Thede, applicant and property owner, stated that he did agree with the conditions. <br />Sheets asked Thede about the homes that he planned to build on the lots. <br />Thede replied they would be approximately 2,000 SF, Victorian and / or Arts and Crafts <br />Bungalow, with an approximate start time of August 2006. <br />Members of the Public: None heard. <br />Commission Questions of Staff and Applicant: No additional Comments. <br /> <br />
