City Council <br />Study Session Summary <br />August 26, 2014 <br />Page 2 of 5 <br /> <br />Therehas been some turnover on the Board but those still on the LLA are experienced. <br />The LLA works well with and has a good relationship with the Police Department. They <br />also appreciate Carol Hanson, Deputy City Clerk who is their staff liaison. <br />There are rumors of a whiskey distillery opening. Council asked if this presented any <br />special requirements. Chair Carlson said it would be a different license for a distillery. <br />He said a distillery would be an interesting addition. Carlson explained that a brew pub <br />is restaurant which brews beer and can also serve other alcohol. Brew pub license is <br />approved locally by LLA before licensing by the State. Manufacturing breweries have <br />no food requirement, but usually have tasting rooms. Brewery license is State issued <br />with no local licensing approval. There is a lot of brewery activity in Colorado. <br />Carlson said the LLA has had no complaints involving recreational marijuana sales. <br />Council member Lipton stated the LLA has done a great job working well with the <br />business community and working to educate the community. <br />Council member Dalton said the Police Department and LLA have done an outstanding <br />job. <br /> <br />Deputy City Clerk Hanson said she very happy there are experienced people serving on <br />the LLA and appreciates their knowledge. <br />Update/Discussion Legal Committee: <br />Council member Jeff Lipton gave an overview of the recent Legal Committee meeting. <br />The Committee had not met for more than a year. Current members are Council <br />members Lipton, Moss and Loo. They were joined in the meeting by City Manager <br />Fleming and Acting Deputy City Manager Muth and Attorney Sam Light. <br />The Committee discussed the role and responsibilities of the Committee and whether <br />the Committee was necessary. The Committee decided they could provide a useful <br />purpose reviewing legal policy issues for City and potential areas that need more <br />granular attention than can be provided by the full Council. <br />Theydiscussed legal settlement and litigation issues. The full Council has been <br />informed of pending issues through confidential memorandum from City Attorney. This <br />process seems to be working well and does not need to change. <br />They had a discussion on the issue of legal liability and defense costs for City staff, <br />board and commission volunteers, and Council members. The Committee agreed to <br />have Sam and Malcolm investigate what City policies would need to be updated to <br />provide broader coverage. They also reviewed several other municipal policies and <br />agreed that Ft. Collins would provide an example of what might be appropriate. <br />
