Planning Commission <br />Staff Report <br />October 9, 2014 <br />recommends the deed restriction be expanded to prohibit any second floor <br />construction on detached accessory structures, including garages. <br />• Building Setback <br />o Required — Front: 20' minimum and 25' maximum <br />o Proposed — Front: Lots 1,2,3 and 6 - 10' minimum; Lots 4 and 5 — 50' <br />maximum <br />Staff analysis — staff acknowledges the need to expand the maximum front <br />setback for safety measures from the mine shaft; staff also acknowledges the <br />request to modify the minimum front setback since there is a 15' public land <br />dedication being used as part of the physical setback. <br />• Building Height <br />o Required — 27' <br />o Proposed — Lots 1,2,3,4 and 6: ranging between 27' to 27'8 "; Lot 5 <br />between 27' to 28'6" <br />Staff analysis — the requested roof height is not a significant change to the Old <br />Town Overlay requirement of 27' and allows for advancements in insulation <br />and energy saving measures. <br />• Roof Pitch <br />• Required — 6:12 <br />• Proposed — 5:12 <br />Staff analysis —a 5:12 roof pitch still provides a character defining roof pitch <br />and is consistent with other structures located in the Old Town Overlay District. <br />• Public Land Dedications <br />• Required — 15% public land dedication <br />• Proposed 10.7% (however they are requesting development costs to be <br />included as cash in lieu) <br />Staff analysis — staff acknowledges the 10.7% land dedication, coupled with <br />the added development costs for the park met the intent of the public land <br />dedication. <br />The LMC requires staff, Planning Commission and City Council use criteria found in <br />Sections 17.28.110 and 17.28.120, when considering a Planned Unit Development <br />and potential waivers to established standards. <br />Section 17.28.110 states, " ... requirements may be waived or modified through the <br />approval process of the planned unit development if the spirit and intent of the <br />development plan criteria contained in section 17.28.120 are met and the city council <br />finds that: <br />9 <br />
