RESOLUTION NO. 72 <br />SERIES 2014 <br />A RESOLUTION APPROVING A LETTER OF UNDERSTANDING BETWEEN THE <br />CITY OF LOUISVILLE AND THE TOWN OF SUPERIOR FOR DESIGN OF A <br />POTABLE WATER INTERCONNECT <br />WHEREAS, the City of Louisville ( "City ") and the Town of Superior ( "Town ") wish to <br />enter into an agreement to design a potable water interconnect system between the two potable <br />water distribution systems; and <br />WHEREAS, a Letter of Understanding has been proposed between the City and the <br />Town to provide for shared funding for design of the Project; and <br />WHEREAS, the City Council finds that the proposed Letter of Understanding is in the best <br />interests of the City and its citizens. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The Proposed Letter of Understanding for design of a potable water interconnect <br />system between the two potable water distribution systems is hereby approved in essentially the <br />same form as the copy of such Letter of Understanding accompanying this Resolution. <br />2. The Mayor is authorized to execute the Amendment on behalf of the City, except <br />that the Mayor is hereby further granted authority to negotiate and approve such revisions to said <br />Amendment as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Amendment are not altered. <br />PASSED AND ADOPTED this 18th day of Nove ber, 2014. <br />ATTEST: <br />Nancy Varra, City Clerk <br />Robert P.
