The motion carried by a <br />vote of 7 -0. <br />ORDINANCE No. 1675, SERIES 2014 — AN ORDINANCE AMENDING CHAPTER <br />9.78 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING PUBLIC <br />CONSUMPTION OF MARIJUANA — 2nd Reading - Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light read Ordinance No. 1675, Series 2014. <br />Public Relations Manager Muth explained during the City Council's discussion of <br />Ordinance No. 1669 on September 16, 2013, the Council asked staff to remove the <br />language including marijuana penalties in Chapter 8 of the Louisville Municipal Code <br />(LMC) and place that language in Chapter 9. This language specifically relates to the <br />use of marijuana in public places. The use of medical and recreational marijuana is <br />legal under Article XVIII, §§ 14 and 16 of the Colorado Constitution, but the public use of <br />marijuana remains unlawful. Chapter 9.76 already contained language related to the <br />outdoor consumption of marijuana. The ordinance adds language specifically listing <br />indoor areas "to which the public is invited or to which the public is permitted." <br />For purposes of this Chapter, `places of business to which the public is invited in or <br />in which the public is permitted," shall include but not be limited to, retail food <br />production or marketing establishments, restaurants, taverns, banks, commercial <br />establishments, theatres, waiting rooms, reception areas, meeting rooms, <br />educational facilities, libraries, recreational facilities, health care facilities, facilities <br />providing live music or sporting events, and public transportation facilities. <br />The City Attorney's office also added a section prohibiting the consumption of marijuana <br />in retail marijuana stores, medical marijuana centers, retail marijuana products <br />manufacturing facilities and medical marijuana infused products manufacturing facilities. <br />
