City Council <br />Meeting Minutes <br />November 18, 2014 <br />Page 13 of 16 <br />language providing that consumption of marijuana is legal in a private residence by <br />patients or persons twenty -one years of age or older in accordance with Sections 14 <br />and 16 of Article XVIII of the Colorado Constitution and other applicable laws. The <br />ordinance amends Section 5.11.020 of Louisville Municipal Code (LMC) with the <br />addition of the definition, and in Section 5.11.265 adds the following prohibition: <br />Marijuana club shall mean a place not used for residential purposes where <br />individuals gather to consume, grow, distribute or otherwise use marijuana or marijuana <br />products for medical or personal use, regardless of whether such place calls itself <br />private or public or charges an admission, membership or similar fee. A medical <br />marijuana business or retail marijuana establishment with valid State and local licenses <br />shall not constitute a marijuana club. <br />Sec. 5.11.265. Marijuana clubs prohibited. The establishment or operation of a <br />marijuana club is prohibited in all zoning districts in the City. <br />Staff recommended the City Council adopt Ordinance No. 1677, Series 2014 on second <br />and final reading. <br />Mayor Muckle called for public comment and hearing none, closed the public hearing. <br />MOTION: Mayor Pro Tem Dalton moved to approve Ordinance No. 1677, Series 2014 <br />on second and final reading, seconded by Council member Leh. Roll call vote was <br />taken. The motion carried by a vote of 6 -0. Absent: Council member Lipton. <br />EXECUTIVE SESSION <br />1. REAL PROPERTY ACQUISITIONS <br />(Louisville Charter, Section 5 -2(c) — Authorized Topics — Consideration of Real <br />Property Acquisitions, but only as to Appraisals and Other Value Estimates and <br />Strategy, and C.R.S. 24- 6- 402(4)(a)) <br />The City Manager is requesting the City Council convene an Executive Session <br />for the Purpose of Consideration of Potential Real Property Acquisitions <br />Concerning Property in Louisville. <br />2. PENDING LITIGATION <br />(Louisville Charter, Section 5 -2(d) — Authorized Topics — Consultation with an <br />Attorney representing the City with respect to pending litigation, and C.R.S. 24-6 - <br />402(4)(b)) <br />The City Manager and City Attorney are requesting the City Council convene an <br />Executive Session for the Purpose of Consultation with Respect to Pending <br />Litigation. <br />
