City Council Meeting Minutes November 18, 2014 Page 13 of 16 language providing that consumption of marijuana is legal in a private residence by patients or persons twenty -one years of age or older in accordance with Sections 14 and 16 of Article XVIII of the Colorado Constitution and other applicable laws. The ordinance amends Section 5.11.020 of Louisville Municipal Code (LMC) with the addition of the definition, and in Section 5.11.265 adds the following prohibition: Marijuana club shall mean a place not used for residential purposes where individuals gather to consume, grow, distribute or otherwise use marijuana or marijuana products for medical or personal use, regardless of whether such place calls itself private or public or charges an admission, membership or similar fee. A medical marijuana business or retail marijuana establishment with valid State and local licenses shall not constitute a marijuana club. Sec. 5.11.265. Marijuana clubs prohibited. The establishment or operation of a marijuana club is prohibited in all zoning districts in the City. Staff recommended the City Council adopt Ordinance No. 1677, Series 2014 on second and final reading. Mayor Muckle called for public comment and hearing none, closed the public hearing. MOTION: Mayor Pro Tem Dalton moved to approve Ordinance No. 1677, Series 2014 on second and final reading, seconded by Council member Leh. Roll call vote was taken. The motion carried by a vote of 6 -0. Absent: Council member Lipton. EXECUTIVE SESSION 1. REAL PROPERTY ACQUISITIONS (Louisville Charter, Section 5 -2(c) — Authorized Topics — Consideration of Real Property Acquisitions, but only as to Appraisals and Other Value Estimates and Strategy, and C.R.S. 24- 6- 402(4)(a)) The City Manager is requesting the City Council convene an Executive Session for the Purpose of Consideration of Potential Real Property Acquisitions Concerning Property in Louisville. 2. PENDING LITIGATION (Louisville Charter, Section 5 -2(d) — Authorized Topics — Consultation with an Attorney representing the City with respect to pending litigation, and C.R.S. 24-6 - 402(4)(b)) The City Manager and City Attorney are requesting the City Council convene an Executive Session for the Purpose of Consultation with Respect to Pending Litigation.
