Davidson reopened the public hearing. <br /> <br />Paul Wood, Planning Director, stated that this was a reconsideration based on new information <br />presented by the applicant. He pointed out that the Letter of Agreement had five or six changes in <br />it. He stated that the agreement was an important basis of understanding between one applicant and <br />essentially one affected property owner to the south. Staffs position was that they did not feel the <br />agreement or anything else, short of final PUD and Plat approval, should vest the applicant with a <br />predetermined number of lots or a sense that the proposed buffering would be adequate. Planning <br />Commission denied this at a public hearing. On the Discussion/Motion (K2 on the Agenda) portion, <br />he stated that it was the applicant's appeal of the Planning Commission's denial of the Plat and PUD. <br />Staff recommended that Council's action on the appeal parallel their action on the ordinance. <br /> <br />Davidson stated that a letter had been received requesting that this item be tabled until they can work <br />out some issues with the CTC Special Tax District. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Jon Lee, Community Development Group, stated that they did want this tabled, because this could <br />not be resolved before January 17, 1995. <br /> <br />Lathrop moved that Council continue this public hearing until the applicants determined a date to <br />resubmit. Seconded by Levihn. Roll call was taken. Motion failed by a 3 - 4 vote with Davidson, <br />Howard, Sisk, and Mayer voting against. <br /> <br />Lee stated that until they meet with the CTC Special Tax District, there would be nothing more to <br />add. <br /> <br />Bill Hayes, 839 McKinley Avenue, Louisville, Colorado, could not understand why this keeps coming <br />back to Council. He felt the developers were trying to wear Council down. <br /> <br />Herb Neubold, 9750 Empire Road, Louisville, Colorado, agreed with Hayes and felt it should be put <br />to rest. <br /> <br />Wood commented that he had received a letter on December 30, 1994, from Herb and Linda Neubold <br />in opposition and he wanted it entered into the record. <br /> <br />Davidson called for anyone else wishing to speak on this ordinance. <br /> <br />NONE <br /> <br />Lee: <br /> <br />We have no choice, but just to withdraw this at this <br />time. <br /> <br />10 <br /> <br /> <br />
