Davidson closed the public hearing and called for Council comments, questions or motions. RECESS Davidson called for a short recess. Davidson called the meeting back to order. Griffiths stated that they had not found anything in the Code which prohibits an individual from filing for another rezoning after one rezoning had been denied. They did not find a provision which allowed for withdrawal of an application for rezoning. She stated that Council may act upon the ordinance one way or another. Mayer moved that Council deny Ordinance No. 1162, Series 1994, an ordinance amending Title 17 of the Louisville Municipal code entitled "Zoning" by rezoning certain property at first reading. Seconded by Sisk. Roll call was taken. Motion passed to deny by a 5 - 2 vote with Lathrop and Levihn voting against. LOUISVILLE SPORTS COMPLEX ANNEXATION RESOLUTION NO. 72, SERIES 1995 - CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO FINDING SUBSTANTIAL COMPLIANCE OF A PETITION FOR ANNEXATION OF CERTAIN PROPERTY FILED BY THE CITY OF LOUISVILLE TO BE KNOWN AS LOUISVILLE SPORTS COMPLEX ANNEXATION, AND SETTING A PUBLIC HEARING THEREON - LOUISVILLE SPORTS COMPLEX ANNEXATION Paul Wood, Planning Director, stated that the city has sole title to the property and the property meets all of the statutory requirements for annexation. The request for zoning of the property will be brought forward at a later date. He stated that the following Ordinance No. 1179, Series 1995, will annex 24 acres. Davidson called for questions or motions. Howard moved that Council approve Resolution No. 72, Series 1995 on an expedited basis. Seconded by Keany. Roll call was taken. Motion passed by a 7 - 0 vote.
