Local Licensing Authority <br />Minutes <br />August 27, 2007 <br />Page 3 of 4 <br />Lipton moved to approve the petition to pay fine in lieu of suspension. <br />Rommelfanger seconded. Roll Call Vote: Wilson -yes, Rommelfanger -yes, <br />Lipton -yes, Carlson -yes and Mulvahill -yes. <br />B. Show Cause Hearing-~ Hei Han Enterprises, Inc. d/b/a Henry's Bar & Grill <br />-Tavern Liquor License - 935 Pine St. (Wilson recused herself and left <br />the room) <br />Vice-Chair Rommelfanger opened the show cause hearing. Stefan <br />Fredricksmeyer, Special Prosecutor for the Local Licensing Authority and Henry <br />Yen, owner and manager of Henry's Bar and Grill, introduced themselves to the <br />Authority. <br />Mr. Fredricksmeyer directed the Authority's attention to a Motion to Dismiss he <br />presented to them. He stateci he had spoken at length to the officer involved in <br />this incident and felt he did not have the evidence to go forward on this show <br />cause. Mulvahill moved the Authority accept the motion to dismiss. <br />Authority member Lipton questioned the number of drinks being served within an <br />hour. <br />Rommelfanger agreed there seemed to be an excessive number of drinks being <br />served per hour. <br />Mulvahill stated he didn't see a violation based on what the law prohibits. <br />Fredericksmeyer reiterated hE; had told Mr. Yen it was up to the Authority <br />whether or not they accepted this motion to dismiss. <br />Lipton suggested another employee in the bar might be helpful during busy <br />times. <br />Rommelfanger reminded the Authority there was a motion to accept the motion <br />to dismiss on the floor. Rommelfanger seconded. Roll Call Vote: Rommelfanger <br />- yes, Lipton - no, Carlson -yes, Mulvahill -yes and Gunning -yes. Wilson <br />recused. Motion to dismiss granted. <br />C. Set Boundaries of the (Neighborhood and Set Public Hearing -New Hotel <br />and Restaurant Liquor License Application -Tibet's Restaurant & Bar, <br />LLC d/b/a Tibet's Restaurant & Bar - 321 McCaslin Blvd. Suite A <br />Wilson moved the boundaries of the neighborhood be the boundaries of the City <br />of Louisville and the public hearing be set for September 24, 2007 at 7:00 PM. <br />Rommelfanger seconded. Roll Call Vote: Mulvahill -yes, Carlson -yes, Lipton <br />- yes, Rommelfanger -yes and Wilson -yes. <br />C. Discussion/Direction new legislation regarding fees <br />Wilson stated she had spoken to a Council member and the suggestion was <br />made to meet in a study session with Council. <br />
