l.)

2.)

3.)

The final design of the emergency access connection to Neodata shall be approved by
the Fire Marshall prior to building permit issuance;
An agreement between Quantum and Neodata shall be in place detailing detention
pond maintenance prior to final approval;
Recovery to the City for the 15" irrigation line on the south side of the lot.

Davidson called for the applicant's presentation.

Don Shonkwiler, H.D. Delaware Properties, Inc., 400 South McCaslin, Louisville, Colorado, was
there to answer any questions.

Bob West, AIA, OZ Architecture, 2336 Pearl Street, Boulder, Colorado 80302, reviewed the
research and development that will occur in the buildings. He stated that there will be a hard surface
loop all the way around the building, as per the Fire Marshall's request. There will be a sidewalk in
from the cul-de-sac up to the main entry sidewalk for pedestrians. The Fire Marshall asked for a
grade section as a secondary access for emergency vehicles between the Neodata parking lot and
Quantum, which the Marshall is reviewing. Concerning the off-site detention pond, City staff asked
if they could possibly develop the existing Neodata pond and enlarge it. The City asked them to
develop a maintenance agreement with Neodata concerning who will maintain the pond. The
agreement is in process and they have gotten Neodata's signature on the document. He reviewed the
site lighting and signage. He stated that the building would be pre-cast and had samples to show
Council. The sloped roofs would be gray concrete tile.

Davidson called for Council questions.

Mayer asked what kind of evergreen trees will be planted.

West was not sure, but stated possibly Ponderosa Pine on the perimeter of the building and spruces
as they came closer to the building.

Mayer wanted to know what the status was of the recovery to the City for the 15" irrigation line.

Tom Phare, Public Works Director, stated that it was approximately $6,800, at worst case, it would
be no more than twice that. That is the money the City requested to reimburse the Golf Course Fund,
which paid for piping the open irrigation ditch that ran offthe irrigation ditch below the Louisville
Lateral, through the Quantum site, and through the Neodata site.

Shonkwiler stated that pursuant to the subdivision agreement with Neodata for their project, there
is a statement in the agreement that discusses the delineation with Neodata's obligation to relocate
the ditch and how they would accomplish that. He understood that the obligation of the property was
satisfied by Neodata's contribution, which was all of the pipe material and the bedding material for
the relocation project. He felt that whatever the amount of this may be, it should not be an obligation
