The agreement does state that t.~e <br />~~ompariy will continue to upciat.e its <br />i`acilities, equipment and services so <br />i:hat the system within the City of <br />Louisville is wit.~in reason as advanced <br /><~;~ the current state of economical <br />feasible technical will allow. The <br />agreement also addresses the fact that <br />tkie cables must be buried underground. <br />T'~~e agreement states that all cables and <br />wires shall be installed were possible <br />underground and parallel to telephone <br />lines. The agreement also requires thGt <br />there be an office and studio within the <br />city. It does not state the hours. The <br />agreement does allow Council to step in <br />to impose certain requirements. if <br />there is a comp 1 aint Cuu:ici 1 does have <br />tze right to request that corrective <br />action be taken. If there is a failure <br />to provide service then the city carp <br />impose a penalty up to $200.00 per day. <br />In terms of what we can do. The <br />Ordinance and the agreement are both <br />silent in regard to this. We do have to <br />give the company advance notice of our <br />concerns and that is generally dons: by a <br />written notice. I did have a brief <br />meeting with the attorney for the cable <br />company and I did give liin~ a general <br />idea of what the areas of concern were. <br />I did inform him that this issue would <br />be taming before the council and I would <br />be giving my recommendation on these <br />matters. One piece of inforrc~ation he <br />did give me was that they subcontract <br />out the burying of the cable lines, but <br />that is still their responsibility. Tl~e <br />agreement also gives us total access to <br />their books and records. <br />My recommendatiui~ is 1) we give them <br />wr~'_tten notification that there are some <br />areas of concerns. 2) I would :::suggest <br />between now and the public hearing date <br />that staff be involved in what is <br />satisfaction in this community or <br />dissatisfaction with the cable service. <br />We need to have all complaints given to <br />staff. We might want to run some type <br />of survey in the newspaper about the <br />level of service, ~o we can gather all <br />information. We may want to look at the <br />level of equipment. At tl-ie public <br />hearing Council receives all the <br />10 <br />
