the attorney then you are going to be able to
control the fees.
Hornbostel: There were several other issues other than fees
with regard to Mr. Williamson. There was the
issue of the fact we had some advice given to us
that I believe was not right and maybe some
information. that was imparted to us. I believe
that is equally as important as what ever fee
structure you have and far that reason we
suggested that we look for another water attorney
along with the other reasons. I believe that we
should continue on what we are doing and look for
a person that can give us a reduction in fees.
But I also believe it is important to have trust
in that person that you are working with and if
you can't feel that person is going to be giving
you all the information then I believe it is
council's discretion to decide to find someone
else.
Sackett: Asked if any of the people that we talked to would
be willing to move their office to Louisville?
Williams: That was never part of any of the proposals nor
did anyone indicate that. The three final
applicants indicated that there would be no charge
for travel time from their office to Louisville.
The charge would be to water court or Denver or
where ever else they may have to qo.
Howard: There are a number of factors that both sides
could argue all night. The fact is that right now
we are given a choice of three by anyone's measure
very effective water attorney firms. I believe
we need to move ahead and vote on these three
firms.
Sackett: Seems to him in the Buchanan case that Mr. Smith
has quite a bit of knowledge about the city's
water issue given that he did quite a bit of the
work when Mr. Williamson was doing the work. My
general impression is he is working for Buchanan
because when Williamson lost our business Steve
had to lay someone off so he went to work for
Buchanan, so that is probably an advantage for us.
The disadvantage is that Buchanan is probably not
as experienced as the senior partners in the other
two groups. The Cope group gave us a junior
partner who is barely out of law school and is
probably well educated but has almost no
experience. Vranesh and Raisch the junior
partner had a great deal of intelligence and had a
great deal of experience in water issues in the
short time he has worked for the firm. So if the
4
