the deed in the body of the ordinance itself. If
you want to proceed and adopt this ordinance on
first reading you may and perhaps at second read-
ing we could come up with some wording to amend
the body of 'the ordinance to refer to the deed.
Davidson: Has the school been contacted with regard to the
ordinance and if so did they have any objection?
Franklin: We have been in contact with the school district
and they have requested a pedestrian easement from
the end of Johnson Avenue to the Louisville Ele-
mentary School grounds. This request has been
met.
Mayor Fauson moved to place Ordinance #1031, Series 1990 out for
publication and set a public hearing for September 4, 1990,
seconded by Carnival. All :in favor.
RESOLUTION #28, SERIES 1990 - REISSUANCE OF BOND TO CLAIRE WEAVER
Read by tittle only, Resolution #28, Series 1990,
"A Resolution authorizing the reissue of a lost
security to Claire Weaver."
Griffiths: This is to reissue bonds to Claire Weaver. Evi-
dence that the bond and coupons pertaining thereto
have been lost and has provided the required
surety bonds. There is a blank in resolution in
terms of the amount that should be charged to
Claire Weaver for the reissue of the bonds. You
may authorize that the City Administrator
determine the cost of the reissue.
Howard moved to adopt Resolution #28, Series 1990 at no cost of
the issuance of the bonds, seconded by Mayor Fauson. All in
favor.
DISCUSSION/MOTION - THE GROVE SUBDIVISION - CONVEYANCE OF PSCO
EASEMENT PROPERTY
Franklin: McStain Enterprises have requested that the City
return a portion of the Public Service Company
Easement which was deeded to the City in July,
1988. After acquiring the PSCO Easement McStain
deeded to the city several street rights-of-way
which passed through the PSCO Easement property.
To accommodate a concrete path obliged on the
Grove Final PUD Plan, McStain also deeded to the
city a triangular piece of the PSCO easement
located west of Outlot A. The Bath was actually
constructed within Outlots A and B-5; this addi-
tional parcel is now fenced as part of the two
lots. Outlot A is landscaped and is owned and
maintained by the City.
5
