If <br />you want to proceed and adopt this ordinance on <br />first reading you may and perhaps at second read- <br />ing we could come up with some wording to amend <br />the body of 'the ordinance to refer to the deed. <br />Davidson: Has the school been contacted with regard to the <br />ordinance and if so did they have any objection? <br />Franklin: We have been in contact with the school district <br />and they have requested a pedestrian easement from <br />the end of Johnson Avenue to the Louisville Ele- <br />mentary School grounds. This request has been <br />met. <br />Mayor Fauson moved to place Ordinance #1031, Series 1990 out for <br />publication and set a public hearing for September 4, 1990, <br />seconded by Carnival. All :in favor. <br />RESOLUTION #28, SERIES 1990 - REISSUANCE OF BOND TO CLAIRE WEAVER <br />Read by tittle only, Resolution #28, Series 1990, <br />"A Resolution authorizing the reissue of a lost <br />security to Claire Weaver." <br />Griffiths: This is to reissue bonds to Claire Weaver. Evi- <br />dence that the bond and coupons pertaining thereto <br />have been lost and has provided the required <br />surety bonds. There is a blank in resolution in <br />terms of the amount that should be charged to <br />Claire Weaver for the reissue of the bonds. You <br />may authorize that the City Administrator <br />determine the cost of the reissue. <br />Howard moved to adopt Resolution #28, Series 1990 at no cost of <br />the issuance of the bonds, seconded by Mayor Fauson. All in <br />favor. <br />DISCUSSION/MOTION - THE GROVE SUBDIVISION - CONVEYANCE OF PSCO <br />EASEMENT PROPERTY <br />Franklin: McStain Enterprises have requested that the City <br />return a portion of the Public Service Company <br />Easement which was deeded to the City in July, <br />1988. After acquiring the PSCO Easement McStain <br />deeded to the city several street rights-of-way <br />which passed through the PSCO Easement property. <br />To accommodate a concrete path obliged on the <br />Grove Final PUD Plan, McStain also deeded to the <br />city a triangular piece of the PSCO easement <br />located west of Outlot A. The Bath was actually <br />constructed within Outlots A and B-5; this addi- <br />tional parcel is now fenced as part of the two <br />lots. Outlot A is landscaped and is owned and <br />maintained by the City. <br />5 <br />
