All in favor. <br />DISCUSSION/ACTION - EXCLUSION FROM THE CHERRYVALE FIRE PROTECTION <br />DIST. - CITY OF LOUISVILLE, LINCOR AND HOMART <br />Brand: On October 24, 1990 the following people met in my <br />office to discuss the requested exclusion from the <br />Cherryvale Fire Protection District: Carey Crain, <br />Don Shonkwiler, Kathy O'Neill and Sharon Miller, <br />Kevin K1 ein and Dave Chaffin and myself . We <br />agreed to recommend to our respective governing <br />bodies that we proceed in the following manner: <br />proceed file an appeal under 32-1-501 and request <br />the Board of County Commissioners to hold the <br />apeal in obeyence for ninety days while we negoti- <br />ate a process under 32-1-502. If it is not possi- <br />ble to come up with a joint plan under 31-1-502, <br />we can then either ask the County Commissioners to <br />take the petitioners' appeal from abeyance and <br />hear it with our knowledge that, should they deny <br />the petitioners' appeal, the next appeal would be <br />to District Court; or we can present separate <br />plans to District Court, one from the petitioners <br />and one from Cherryvale and let the District Court <br />put together a plan. <br />Howar: What would the potential cost of the appeal be. <br />Griffiths: Because of the time frame for filing the appeal <br />(due tomorrow}, to prepare the documents, we spent <br />about 5-6 hours total; we will not bill the city <br />for this time if the Council decides not to au- <br />thorize us to file the appeal. <br />Brand: Also stated that the Cherryvale Fire District <br />would like to see the policy with regard to annex- <br />ing to the City of Louisville and who provides <br />fire protection service. <br />3 <br />
