Council did not feel that there was policy in place concerning <br />who provides fire protection service when it comes to annexing to <br />the city. It was stated that if the annexor wants to be included <br />in the Louisville Fire District that request was placed in the <br />Annexation agreement. Council felt that each of the annexations <br />that are brought before Council should be looked at, at that <br />time, and then a discussion made with regard to which Fire Dis- <br />trict should be serving the property. <br />Council was also concerned with the legal costs of this matter. <br />Mayor Fauson moved to authorize the City Attorney to file an <br />appeal of the denial by the Cherryvale Fire Protection District <br />Board of the requested exclusion on behalf of all the parties <br />seeking exclusion and that the City Administrator should proceed <br />with the negotiations with the Cherryvale Fire District and that <br />the consensus of the Council was that there is no policy in place <br />with regard to which Fire District an annexor should be served <br />by, seconded by Carnival. All in favor. <br />ORDINANCE #1033, SERIES 1990, LOUISVILLE PLAZA - REZONING TO PCZD <br />- 1ST READING - SET PUBLIC HEARING. <br />Griffiths read by title only Ordinance #1033, <br />Series 1990, "An Ordinance Amending Title 17 of <br />the Louisville Municipal code entitled "zoning" by <br />rezoning certain property located generally at and <br />owned by Clifford S. Foster, South Boulder Road <br />Corporation, David and Kathryn King." <br />Franklin: South Boulder Road Corporation is requesting <br /> rezoning to PCZD of a 53-acre parcel located north <br /> of South Boulder Road and East of Highway 42. The <br /> proposed K-Mart/King Soopers shopping center is <br /> located on a portion of the property. The purpose <br /> of the PCZD request is to allow relocation and <br /> interim occupancy of the existing dwellings on the <br /> property and to allow for day care as an <br /> additional permitted use. We are requesting that <br /> Ordinance #1033 Series 1990 be placed out for <br /> publication and schedule the public hearing for <br /> November 20, 1990. <br />Griffiths: The title of the Ordinance should be corrected to <br /> includ the general locaton of the property. <br />Mayor Fauson moved to place Ordinance #1033, Series 1990 out for <br />publication and that the title of Ordinance be corrected to <br />reflect the location of the property, seconded by Carnival.
