ORDINANCE #1033, SERIES 1990, LOUISVILLE PLAZA-REZONING TO PCZD - <br />2ND READING - PUBLIC HEARING <br />Mayor Fauson opened the public hearing. Proof of certification <br />was established. <br />Griffiths read by title only Ordinance #1033, <br />Series 1990, "A Ordinance amending Title 17 of the <br />Louisville Municipal Code entitled "Zoning" by <br />rezoning certain property located generally at the <br />northeast corner of Highway 42 and South Boulder <br />Road and Owned by Clifford S. Foster, South Boul- <br />der Road Corporation, David and Kathryn King." <br />Franklin: South Boulder Road Corporation requests rezoning <br />to PCZD of a 53-acre parcel located north of South <br />Boulder Road and East of Highway 42. The proposed <br />K-Mart/King Soopers shopping center will be locat- <br />ed on a portion of the property. The purpose of <br />the PCZD request is to allow relocation and inter- <br />im occupancy of the existing dwellings on the <br />property and to allow for day care as an addition- <br />al permitted use. With this request all of the <br />northeast part of Louisville will be under the <br />PCZD district and general development plan re- <br />strictions. <br />Griffiths: Stated that in Section 1 line 5 the word "that <br />the" should be removed and the word "property" be <br />placed after such. <br />Mayor Fauson closed the public hearing and called for a motion. <br />Howard moved and Szymanski seconded to adopt Ordinance #1033, <br />Series 1990 with the City Attorney's corrections. By Roll Call <br />Vote Motion passed 7-0. <br />ORDINANCE #1034, SERIES 1990, AMENDING SECTION 3.16.020 OF <br />LOUISVILLE MUNICIPAL CODE REGARDING CAPITAL IMPROVEMENT FEE, 2ND <br />READING - PUBLIC HEARING <br />Mayor Fauson opened the public hearing. Proof of certification <br />was established. <br />Griffiths read by title only Ordinance #1034, <br />Series 1990, "A Ordinance amending Section <br />3.16.020 of the Louisville Municipal Code <br />concerning the Capital Improvement fee and <br />providing for a credit against such fee." <br />Brand: Gave a brief overview regarding the use tax. This <br />item will provide for builders who pay the service <br />expansion fee, buy the material in Louisville to <br />within 60 days apply for a refund on the sales <br />tax. <br />3 <br />
