1990 budget for the following reasons: 1) <br />unanticipated revenues not assured at the time of <br />the adoption of the budget, 2) to appropriate <br />funds for additional authorized 1990 projects, and <br />3) 1990 expenditures that are exceeding the budget <br />appropriation. Finance Committee did review this <br />and is recommending adoption of Resolution No. 37. <br />Mayor Fauson asked for public comments. None <br />Mayor. Fauson closed the public hearing. <br />Davidson moved to adopt Resolution No. 37, Series 1990 budget <br />amendments, seconded by Sackett. By Roll Call Vote Motion Passed <br />5-0. <br />Councilman Carnival rejoined the meeting. <br />AUTHORIZATION TO PERFORM INVENTORY/ANALYSIS OF STATUS OF <br />CENTENNIAL VALLEY AGREEMENT AND AMENDMENTS <br />Brand: I am requesting authorization, to be performed by <br />our City Attorney, an inventory and analysis of <br />the status of the Centennial Valley Agreement and <br />Amendments. This agreement was entered into <br />January 29, 1982. Since that time there has been <br />nine amendments to the original agreement. In the <br />original agreement there are certain <br />responsibilities by the City and by Homart. <br />Several years ago an attempt was made to do a <br />comprehensive inventory in house. It was beyond <br />the capability of the staff because of both the <br />complexity of the task and the demands of day-to- <br />day responsibilities. The Mayor tells me he has <br />been concerned about this inventory for quite some <br />time and requested the attempted inventory. <br />Councilman Sackett voiced this concern the evening <br />you first met with Griffiths and Tanoue. Now that <br />Griffiths & Tanoue are appointed as continuing <br />city attorney, I recommend that we ask them to <br />perform this needed inventory/analysis. This work <br />can be carried out at the law clerk/paralegal <br />level. There is no way to estimate how many hours <br />it will take. It will require the reading of all <br />the documents then working with the city staff to <br />determine which obligations have been fulfilled <br />and which have not. This would result in an <br />overall summary of the status of the agreement and <br />amendments: what were the City's responsibilities, <br />which have been fulfilled, which remain; and what <br />were Homart's responsibilities, which have been <br />fulfilled, which remain. Also an issue with Mr. <br />Biella's land is involved. <br />
