Phare: We do not take water through any of the delivery <br />systems on the south side of U.S. 36. It is a <br />possibility in the future, and the pipe line <br />should accommodate that. <br />Davidson: Do we have an idea of what this is worth? <br />Phare: I have not seen an appraisal on this. The Ditch <br />Company has been talking about this for about a <br />year. <br />Davidson: I think I would like to see an appraisal on this. <br />Phare: Stated that the Ditch Company thought this was a <br />fair appraisal. <br />Council had some concerns about a fair appraisal of the land and <br />if $90,000 was a fair price. The people that negotiated the <br />agreement felt it was a fair price. <br />Howard moved to authorize the Mayor and the City Clerk to execute <br />the agreement abandoning the easements and rights-of-ways for <br />irrigation ditches related to the South Boulder and Coal Creek <br />First .Extension Ditch with Richmond Homes Inc. with further <br />authorization to execute a quit claim deed for the same interest <br />of a prorated fee of no less than 530,000 contingent upon an <br />appraisal of the land, seconded by Sackett. <br />Howard amended his motion and deleted contingent upon an <br />appraisal, seconded by Sackett. Motion passed 5-l, with Davidson <br />voting no. <br />Councilman Carnival asked to be excused from the next Agenda <br />Item. Councilman Carnival left the room at this time. <br />RESOLUTION NO. 37, 1990 - 1990 BUDGET AMENDMENTS - PUBLIC HEARING <br />Mayor Fauson opened the public hearing. Certification of <br />publication was established. <br />Griffiths read by title only, Resolution No. 37, <br />1990, "A Resolution amending the 1990 budget by <br />increasing revenues and appropriations in the <br />General, Capital Improvement, Cemetery, Debt <br />Service, Capital Construction, Water, Wastewater, <br />and Golf Course Funds." <br />Asti-Caranci: Resolution No. 37 will amend the 1990 Budget. <br />Colorado Budget Law requires that the Resolution <br />be adopted at a public hearing after publication <br />of the proposed Resolution by a majority vote of <br />the City Council.
