Mayer and seconder, Howard, accepted that.

Wood wanted to clarify that it pertained to the front setback and the difference, the average between
frontage. You could go into that 20', if you are averaging with your neighbor with in 5'.

Sisk stated "exactly."

All in favor.

ORDINANCE NO. 1196, SERIES 1995 AMENDING CHAPTER 9.90 OF THE
LOUISVILLE MUNICIPAL CODE CONCERNING UNCLAIMED PROPERTY - 1ST
READING - SET PUBLIC HEARING 8/1/95

Griffiths read by title only Ordinance No. 1196, Series 1995, "An ordinance amending Chapter 9.90
of the Louisville Municipal Code concerning unclaimed property."

Davidson called for questions or motions.

Keany moved that Council approve Ordinance No. 1196, Series 1995 on first reading, set it out for
publication, and set a public hearing on August 1, 1995. Seconded by Howard. All in favor.

Keany stated that there was supposed to be information provided with item 3D on the Consent
Agenda and none had been provided and yet it was approved. He asked for that information.

Bill Simmons, City Administrator, stated that he would provide that information the next day.
DISCUSSION/DIRECTION - SOLID WASTE AUTHORITY

Mayer stated that at the last Work Session Council had directed the City Attorney to draft some
language that would resolve the Council's concerns with the present Intergovernmental Agreement,
which could be presented to the Authority. Then, if acceptable, maybe Louisville would become a
signatory. He asked Council if the language the City Attorney had drafted was sufficient. He wanted
to know what insurance is procured by the Authority, before Council agreed to anything.

Davidson felt the word "hazardous" should be struck to alleviate the liability issue and insurance. He
asked if Council wanted to join the Authority if those provisions were met.

Mayer stated that he would present Council's concerns to the Authority.

OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA

12
