Howard moved that Council approve Ordinance No. 1194, Series 1995, vacating a portion of Harper
<br />Street and Lincoln Avenue and a 7.5' strip of land within the Fisher Subdivision and declaring it an
<br />emergency. Seconded by Sisk. Roll call was taken. Motion passed by a 6 - 1 vote with Davidson
<br />voting against.

<br />Paul Wood, Planning Department, stated that the revised and amended resolution, with three
<br />conditions, was included in Council's packet reflecting the standing of the proposed use with respect
<br />to the currently adopted zoning ordinances of the City, as well as building colors and building
<br />elevations. He asked to make part of the record three letters that were received subsequent to July
<br />6. He recommended one additional condition be added to the resolution: That the three trees located
<br />in the Northern Natural Gas easement be relocated out of the easement.

<br />Davidson called for the applicant's presentation.

<br />Don Shonkwiler, H.D. Delaware Properties, Inc., 400 South McCaslin, Louisville, Colorado, was
<br />there to answer any questions.
<br />
<br />Jim Shipman, Isaacson, Rosenbaum, Wood & Levy, P.C., 633 - 17th Street, Denver, Colorado,
<br />representing Security Capital Pacific Trust, presented additional information, including letters, to
<br />Council. He asked that Councilman Keany be allowed to vote on the motion from the July 6 meeting.

<br />Keany stated that he had reviewed the tapes from the July 6 meeting and he had no additional
<br />questions.

<br />Davidson called for public comments.

<br />Rebecca L. Fischer, 215 South Tyler Avenue, Louisville, Colorado, stated that from any uses there
<br />could be on Parcel H, the Homestead is one of the best, most attractive, and lowest impact.
<br />
<br />Susan Morris, 939 West Maple Court, Louisville, encouraged Council to vote against this proposal.
<br />She felt this was more a multi-family use instead of a hotel use, which she felt was inappropriate.
<br />
<br />Anne-Marie Pattie, 748 Orchard Court, Louisville, Colorado, felt this project would have a negative
<br />impact on the City.
<br />
<br />Ray Schlott, 647 Manorwood Lane, Louisville, Colorado, spoke of the letter he had sent to Council
<br />in opposition to this project. He felt the use and benefit to Louisville should be reviewed.
