Griffiths read by title only Ordinance No. 1194, Series 1995, "An ordinance vacating a portion of <br />Harper Street, and Lincoln Avenue and a 7.5 foot strip of land within the Fisher Subdivision and <br />declaring an emergency." <br /> <br />Bill Simmons, City Administrator, stated that in February 1995 the City was contacted by an owner <br />of land within the Fisher Subdivision who had been informed by a title company that there were no <br />records showing vacation of certain portions of Harper Street, Lincoln Avenue, and a 7.5' strip of <br />land within that subdivision. This ordinance corrects that and declares it an emergency. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Tom Bennett, 1297 South 104th Street, stated that the property is being sold to the Louisville <br />Housing Authority and will be future senior citizen housing. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on this ordinance. <br /> <br />Michael Reese, Housing Planner for the Louisville Housing Authority, P.O. Box 471, Boulder, <br />Colorado, asked Council to support this ordinance. <br /> <br />Davidson called for anyone else wishing to speak on this ordinance. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments, questions, or motions. <br />Davidson stated, concerning declaring this an emergency, that he did not feel it met the State criteria. <br /> <br />Susan Griffiths, City Attorney, stated that the courts had deferred to the opinions of elected officials <br />as to what constitutes a matter requiring preservation of public health and safety. <br /> <br />Davidson asked the seller if going through the 30 day wait would bring him a hardship. <br /> <br />Bennett stated that the Housing Authority had already begun with their architects and planners. The <br />error had occurred in '70's or '80's and he had been trying to get it corrected for about 90 days. <br /> <br />Davidson felt this should go through the regular ordinance process and not as an emergency. <br />Sisk felt it was the City's error originally and should be corrected as an emergency ordinance. <br /> <br /> Levihn stated that it had been advertised in the Louisville Times as an emergency. The public heating <br /> was advertised for tonight for comments. He agreed with Sisk. <br /> <br /> <br />
