He felt the space allocation made the best sense. <br /> Council member Loo felt it was a matter of fairness of what is coming out of the funds. <br /> Council member Lipton noted the allocation of space may vary over a period of years. <br /> He stated at this point, it is merely an estimate. <br /> DISCUSSION/DIRECTION — ZAYO PARTNERSHIP FOR CONDUIT-FIBER <br /> Mayor Muckle requested a staff presentation. <br /> IT Director Neves explained staff is seeking direction from Council on a draft agreement <br /> with the Zayo Group for sharing City conduit through a nonexclusive public-private <br /> partnership. Under this partnership the Zayo Group would perform the build/ install of <br /> the additional City fiber and conduit to the vicinity of the new City Shops facility on Dillon <br /> Road and give ownership of the conduit and fiber to the City in exchange for shared <br /> space to over-pull Zayo micro-conduit within the existing 6.5 miles of City conduit. The <br /> proposed agreement is currently being reviewed by the City Attorney's office. <br /> Based upon similar agreements between Zayo and other municipalities, staff estimated <br /> the leased one-time payment-trade value of the City conduit in the proposed agreement <br /> to be approximately $190,000. The cost through the City's fiber contractor for fiber- <br /> conduit installed, between S. 88th Street and Dillon Road to S. 104th Street and Dillon <br /> Road has been estimated at approximately $200,000. <br /> The benefits of the public-private partnership include: <br /> • Cost savings to the City which would offset a currently unfunded capital fiber <br /> project. <br /> • Maintenance, repair and response support associated with having a private <br /> entity, Zayo Group, in City conduit. <br /> • Agreement is non-exclusive. <br /> The risks associated with the public-private partnership include: <br /> • Loss of conduit capacity. <br /> • Potential damage to City/BVSD fiber during install. <br /> IT Director Neves introduced Alex Abeyta Project Planner with Zayo Group, who would <br /> be available to address Council's questions. Staff requested Council direction on <br /> whether the IT Division should proceed with further review and bring a final proposal to <br /> establish a public-private partnership with Zayo Group for fiber and conduit. <br /> COUNCIL COMMENT <br /> 39 <br />
