City Council <br /> Meeting Minutes <br /> March 18, 2014 <br /> Page 18 of 20 <br /> sits on the LRC. The LRC previously committed to partially fund this City project and is <br /> proposing the amendment to the IGA. <br /> Staff recommended City Council approval of Resolution No. 17, Series 2014, which <br /> approves the First Amendment to the cooperation agreement for funding of the South <br /> Street Gateway project. <br /> COUNCIL COMMENTS <br /> Council member Stolzmann had several concerns relative to the timing and the <br /> financing of the projects. She did not feel there was enough information for the City <br /> Council to make a decision. Economic Development Director DeJong explained the <br /> timing and cost calculations cannot yet be updated, because they have not received a <br /> response from BNSF on the agreement. <br /> Council member Stolzmann was interested in knowing the timeframe for the <br /> development projects in the area. Mayor Muckle explained the TIF funding for the <br /> entire urban renewal area will be going to this project. This is an exception to the LRC's <br /> general principal that funding be based on the area of improvements. With respect to <br /> project development in the area, DELO is scheduled to come before the Planning <br /> Commission. <br /> Planning Director Russ explained both DELO and the Coal Creek Station will be coming <br /> before the Planning Commission in May and June and before the City Council in June <br /> and July. <br /> Mayor Muckle was hopeful the extended date would provide some leverage with BNSF <br /> and there will be some agreement with the railroad in 2015. <br /> City Manager Fleming explained the issue is waiting for BNSF to take the next step. <br /> The City anticipates it will take place this year or next. Planning Director Russ <br /> explained the BNSF Project Manager was not responsive, but his supervisor contacted <br /> the Public Works Department. Their review is anticipated in late spring or early <br /> summer. Once their review is complete the design can be modified and hopefully the <br /> November 2014 deadline for the contract can be met. <br /> Mayor Muckle explained the LRC has already approved the contract. He felt the <br /> agreement in force made sense. <br /> Council member Loo agreed it was difficult to work with the railroad and was <br /> comfortable with the proposed agreement. Council member Jasiak concurred. <br /> Council member Lipton asked about the length of the construction process. Planning <br /> Director Russ explained it is a two-stage construction. BNSF will build the structure in <br /> 43 <br />
