City Council <br /> Meeting Minutes <br /> March 18, 2014 <br /> Page 7 of 20 <br /> MOTION: Council member Lipton moved to approve Ordinance No. 1660, Series 2014, <br /> the second option purchasing the parcel and including include Section 7, which <br /> provided for the demolition of the building within twelve months. The motion was <br /> seconded by Mayor Pro Tem Dalton. <br /> Mayor Muckle offered a friendly amendment, which clarified the City would not sell more <br /> than 1 .8 acres. Council member Lipton and Mayor Pro Tern Dalton accepted the <br /> friendly amendment. <br /> Council member Stolzmann asked if it could be 0 to 1 .8 acres. City Attorney Light <br /> stated additional language could be added to provide flexibility in Section 3 —"Sale and <br /> disposal of all, some or none of the Improved Lot, not to exceed 1 .8 acres". <br /> Council member Stolzmann stated Council member Jasiak made a compelling <br /> argument on opening the entire park for a community. She felt any use of the building <br /> would create parking problems. <br /> City Attorney Light clarified Council member Lipton's motion would amend the <br /> ordinance as follows: <br /> The inclusion of the seconding reading amendment to the 5th Whereas: "all or a portion <br /> of which the City may sell and dispose of after acquisition" <br /> The addition of Section 7: The City Manager and City staff are hereby authorized and <br /> directed to make arrangements to have all buildings on the Property including <br /> those on the Improved Lot removed within 12 months after the date of closing on the <br /> Property. <br /> A change to Section 3 - "Sale and disposal of all, some or none of the Improved Lot, not <br /> to exceed 1 .8 acres". <br /> MOTION: Council member Jasiak offered a substitute motion to approve Ordinance <br /> No. 1660, Series 2014, which would purchase the entire 5.13 parcel for parks and open <br /> space purposes, seconded by Council member Stolzmann. <br /> City Attorney Light clarified if the vote on the substitute motion passes, the first motion <br /> made by Council member Lipton will not be voted on. However if the substitute motion, <br /> made by Council member Jasiak fails, the first motion will be voted on by City Council. <br /> City Attorney Light clarified Council member Jasiak's motion would adopt an ordinance <br /> for just parks and open space purposes. The ordinance would have a different title, <br /> which would state for purposes of parks and open space purposes. The revisions would <br /> be as follows: <br /> • The 4th Whereas: "Approximately 5.13 acres parks and open space acquisition" <br /> • Remove the 5th and 6th "Whereas" clauses relating to the subdivision concept. <br /> 32 <br />
