City Council <br />Meeting Minutes <br />March 17; 2015 <br />Page 17 of 31 <br />MOTION: Mayor Muckle moved items 1,2,3 and 4 of the 245 North 96th Street Project <br />be continued to the April 7th City Council meeting. The motion died for lack of a second. <br />Council member Lipton stated the City Attorney advises the annexation and zoning <br />ordinance and the annexation agreement could be approved this evening and staff and <br />the County have 60 days to work on the financial agreement. His concem centered on <br />the fiscal analysis. He requested the staff assure Council that they have examined the <br />fiscal analysis and it is accurate and reflects the right numbers. <br />Planning and Building Safety Director Russ explained the staff received the fiscal <br />impact study on the moming of March 16th. He reviewed it against the consistency of <br />the GDP and made sure the numbers and the square footages are consistent with what <br />is allocated within the GDP. There was an increase in fiscal performance due to the <br />change from non - profit use to a retail use.. The consultant (EPS) has done a number of <br />fiscal impact studies for Louisville and they know the City's methodology and there is <br />high confidence the model is correct. It shows an affordable housing project will show a <br />negative fiscal retum. The fiscal model is theoretical and not budget based. <br />Council member Lipton stated his view the fiscal model is directional and it is certain <br />this project will not make money for the City. He did not like receiving the impact study <br />without having a chance to look at the data prior to the night of the meeting. He asked <br />City Attorney Light if there was still an opportunity to review the impact study, if the <br />annexation and zoning ordinance and annexation agreement were approved this <br />evening but conditioned by approval of the fiscal model. <br />City Attomey Light explained the Council could act on Items 1 -3 and would not be <br />bound by the financial incentives. The City and County will continue to work toward <br />mutual financial agreement during the next 60 days. He did not think the zoning could <br />be conditioned upon the approval of the fiscal model. <br />Planning and Building Director Russ stated the County gave the City a fully vetted fiscal <br />model for the non - profit. He explained nothing in the zoning code is tied to the fiscal <br />model. He requested an update to the model two weeks ago and apologized for timing <br />of the delivery of the fiscal model. He noted the worst case scenario would be the first <br />model for the non- profit. <br />Mayor Muckle did not feel the model would change much. Council member Lipton <br />agreed but was concemed with the process. <br />ORDINANCE No. 1679, SERIES 2015 <br />MOTION: Council member Lipton moved to approve Ordinance No. 1679, Series 2015; <br />seconded by Mayor Muckle. <br />
