City Council <br />Meeting Minutes <br />March 17, 2015 <br />Page 16 of 31 <br />Council member Stolzmann stated in looking at the annexation, zoning and financial <br />assistance agreement, she was hesitant to consider past history in quasi- judicial <br />matters. <br />Council member Lipton inquired whether the County wanted to proceed if everything <br />could not be approved at once. Frank Alexander explained if the project is not approved <br />as a package, it cannot move forward. He asked whether the Council preferred to <br />continue this matter to the next meeting. <br />City Manager Fleming asked City Attorney Light if the County does not like the financial <br />assistance package the City approves, do they have to file the documents to execute <br />the annexation or not. <br />City Attorney Light stated the County could probably not file the documents. The City <br />and County have 60 days to reach agreement on the financial agreement. The applicant <br />reserves the ability to withdrawn their annexation petition and not annex the property if <br />they don't' agree with the incentive package.. If the annexation and zoning ordinance <br />and annexation agreement were approved, it would be conditioned upon the City and <br />the County working within the next 60 days to enter into a mutually acceptable incentive <br />agreement. He noted the direction given on the incentive package is not binding. <br />Council member Keany clarified his comments on past partnerships with the County <br />was in reference to Section 8 (a) (4) (the financial package) and not the quasi- judicial <br />process, which can only be considered based on the evidence as presented. <br />Mayor Muckle. asked Council if they agree to contribute $1 Million dollars between now <br />and 2018 to this significant project for the community. He addressed rebating fees and <br />noted the City has rebated frees on dozens of business assistance packages and it is <br />always from the General Fund. He stated the City does this for business and can they <br />not do this for affordable. housing. He asked the Council for a show of hands who are <br />willing to give direction to staff on the recommended assistance package. <br />Council member Loo commented the Council does do business assistance packages <br />but usually they do not have such a huge negative economic financial impact. She saw <br />a big difference and felt Council must go into this with their eyes open. <br />Council member Stolzrnann asked for clarification on the hand vote. Mayor Muckle <br />asked if Council is willing to approve the fiscal support staff has recommended, which <br />totals $1 Million. Three Council members' hands rose in support of the direction to staff. <br />Council member Stolzmann stated she could get there but there is not enough <br />information to understand the road piece or the building permit piece. She noted the <br />projects for funding in 2018 include the Public Works drainage for the North End; a <br />pedestrian/drainage underpass and Highway 42 improvements. She felt if there is more <br />information at the next meeting she could give direction to staff. <br />
