Keany did not like the "golden oak" exterior of the building.

Avery stated that the color scheme is the same one used on all other Ruby Tuesday's in the United
States.

Sisk did not like the exterior color either. He preferred a brick veneer.

Howard was pleased that the trees had been added, but asked if something could be done with the
exterior of the building.

Chenowski stated that their color scheme is part of their identity.

Lathrop would like to see the color scheme be lighter.

Sisk moved that Council not approve Resolution No. 47, Series 1995, the Final PUD Development
for Ruby Tuesday. Seconded by Mayer.

Susan Griffiths, City Attorney, stated that if the motion passed, it would be necessary to set forth a
summary of the reasons for not approving it.

Roll call was taken. Motion failed by a 2 - 5 vote with Davidson, Keany, Howard, Lathrop, and
Levihn voting no.

Lathrop moved that Council continue Resolution No. 47, Series 1995, until October 3, 1995.
Seconded by Keany.

Avery approved of this if Coundil would suggest color for a starting point.

Lathrop withdrew his motion. Seconder, Keany, agreed.

Lathrop moved that Council approve Resolution No. 47, Series 1995, with several conditions: That
the neon lighting be the channel lighting; that the exterior color be Sherwin Williams 2824 Golden
Oak; and that the landscaping be approved as amended. Seconded by Howard.

Wood asked for clarification - if the condition was consistent with the proposed channel lighting.

Lathrop:

Davidson:

Lathrop:

Yes.

So, you're also removing the two conditions that are
currently in there, fight?

That is correct.
