Roll call was taken. Motion passed by a 6 - 1 vote with Sisk voting against.

RESOLUTION NO. 50, SERIES 1995 - APPROVING AN AMENDMENT TO RESOLUTION
NO. 30, SERIES 1995 FOR PARCEL

Tom Phare, Public Works Director, stated that on July 6, 1995, the Parcel H Final PUD Development
Plan was approved with conditions. One condition related to how bike lanes and bike traffic was to
be accommodated on McCaslin Blvd. along the project's frontage. Since the July 6 Council meeting
staff and the developer's traffic engineer have researched guideline references on how to
accommodate on-street bicycles. The circumstances most pertinent to this project indicate an
unmarked on-street bicycle lane is recommended. The Parcel H developer would construct the
pavement necessary to install a bike lane in the future, if needed, and would also widen the proposed
sidewalks along McCaslin Blvd. from 5' to 8'. This solution would allow the City to mark the bike
lane as it wished, in the future, while still accommodating off street bike facilities adjacent to
McCaslin Blvd.

Davidson called for Council questions or motions.

Howard moved that Council approve Resolution No. 50, Series 1995, amending Resolution No. 30,
Series 1995. Seconded by Keany. All in favor.

ORDINANCE NO. 1202, SERIES 1995 - VACATING A PORTION OF STERLING
HEIGHTS SUBDMSION LOCATED IN THE SOUTHEAST QUARTER OF SECTION 13,
SECTION 1 SOUTH, RANGE 70 WEST, SIXTH PRINCIPAL MERIDIAN, BOULDER
COUNTY, COLORADO, WITHIN THE CITY OF LOUISVILLE - 1ST READING - SET
PUBLIC HEARING 10/3/95

Griffiths read by title only Ordinance No. 1202, Series 1995, "An ordinance vacating a portion of
Sterling Heights Subdivision located in the southeast quarter of Section 13, Township 1 south, Range
70 west, Sixth Principal Meridian, Boulder County, Colorado, within the City of Louisville."

Paul Wood, Planning Director, stated that in conjunction with the proposed site development plans
for Home Depot, the proposed vacation of the 60' wide fight-of-way in the Sterling Heights
Subdivision follows in sequence behind the annexation of the Sterling Heights right-of-way. Planning
Commission approved a resolution recommending approval of the vacation to the City Council on
September 12 with three conditions of approval. Concerning condition No. 3, which is related to a
letter in Council's packet from Roy Gavert of Sterling Heights who objected to the right-of-way
vacation. Wood stated that Mr. Gavert and the applicant will be meeting with the applicant on
Friday. The applicant and staff agree that an emergency access easement will be dedicated across the
southern portion of that right-of-way.

Davidson called for Council questions, comments, or motions.

6
