does not apply to political subdivisions or charitable corporations. There are no current exemptions
for government entities or charitable organizations for sewer and water taps. Staff recommended that
there be no waiver of either of those fees. Total fees would be $331,759.05. Staff recommended that
41% of those be waived bringing the total fees to $195,316.00. In addition the LHA had asked the
City to extend the waterline on Garfield to improve the waterflow to the building to meet fire
regulations. Public Works preferred to install the main from South Boulder Road consistent with the
overall Master Plan, with City crews patching the road. Estimated cost would be $35 - $40,000. The
LHA also requested the City complete the sidewalk on Garfield between the proposed site and
Griffith. Estimated cost would be $4,500 to extend the sidewalk on Garfield from the project site to
Griffith. To include the sidewalk in front of the site would be approximately $7,500. The LHA
wanted the waived fees that Council decided on at this meeting to also apply to the family project that
they will be presenting within the next few months. Attached to Council's packet was a draft letter
of support from the Mayor to the Colorado Department of Local Affairs.

Davidson felt that the entire Council should be present to make the decision as to whether they
would waive the same fees for the family project.

Davidson called for Council questions.

Mayer wanted to know who would hold title to the property.

Reese stated that the LHA and the City of Louisville would.

Kelley reviewed that the fees waived would be $136,443.05, plus $7,500 for sidewalks and water
lines.

Davidson clarified that it would be about another $50,000 in round numbers. He stated that Council
direction was to waive certain fees for LHA - Senior Housing and draft a resolution stating same.

Council approved the draft letter.

DISCUSSION/DIRECTION - REQUEST TO AMEND 1992 SEWER AGREEMENT

Bill Simmons, City Administrator, stated that Superior had sent a letter requesting that the City of
Louisville modify the 1992 Sewer Agreement to allow for the disconnection fi.om the Louisville sewer
system of all users being serviced currently in the Coal Creek Basin, within the Town of Superior.
He and the Mayor had a meeting with the Mayor and Town Manager of Superior prior to getting this
letter. All tap fees would be collected up to the point of disconnection. Staff had reviewed this and
had found no reason to object to the disconnection.

Davidson announced that Rob Lathrop had just arrived at the Council meeting.

Mayer asked about the existing infrastructure going over to Superior.

2
