Mayor Fauson moved and Scarpella seconded to place <br />Ordinance #983, Series 1989 out for publication <br />and set a public hearing for March 7, 1989. <br />Motion carried 6-0. <br />ORDINANCE #984, SERIES 1989 - AMENDMENT TO PUBLIC SERVICE CO. FRANCHISE <br />AGREEMENT - 1ST READING, <br />SET PUBLIC HEARING Read by title only Ordinance #984, Series 1989, <br />"An Ordinance amending Ordinance #544 concerning <br />the Franchise granted to Public Service Company of <br />Colorado." <br />Stahl explained that this ordinance is necessary <br />to amend the Public Service Company Franchise <br />which will provide three modifications to the <br />current Agreement. Specifically, this will <br />provide to the City on an annual basis 1~ of gross <br />sales in Louisville that could be utilized at <br />Council's discretion for undergrounding of <br />utilities. Secondly, for users that pay in excess <br />of $5,000 annually in gas and electric, the City's <br />franchise fee would increase to 3~ (currently 2~). <br />Lastly, if a more lucrative agreement is <br />negotiated with any city in the surrounding area, <br />Louisville would automatically become a <br />beneficiary to those provisions that were included <br />in that respective city's agreement. <br />Ferrera moved and Mayor Fauson seconded to place <br />Ordinance #984, Series 1989 out for publication <br />and set a public hearing for February 21, 1989. <br />Motion carried 6-0. <br />OTHER: <br />U.S. 36 TOLL Stahl explained that Boulder County Commissioners <br />have requested that the cities adjacent to U.S. 36 <br />officially oppose re-establishing U.S. 36 as a <br />toll road currently being discussed in the <br />legislature and submit Council's written objection <br />by Wednesday, February 8th. Sackett moved and <br />Carnival seconded to oppose this proposed bill. <br />After Council discussion, it was unanimously <br />approved to draft a letter opposing this proposal <br />and directed staff to initiate Council's official <br />letter of opposition. <br />PUBLIC COMMENTS None. <br />COUNCIL COMMENTS AND COMMITTEE <br />REPORTS None. <br />EXECUTIVE SESSION Mayor Fauson called far a short recess and move <br />into an Executive Session. <br />11 <br />
