PRESENTATION/DISCUSSION - SCHEMPP GENERAL DEVELOPMENT PLAN FOR POW WOW <br />GROUNDS The owner Herman Schempp, Schempp Park LTD., has <br />requested approval of a General Development Plan <br />for the property which was rezoned to PCZD by <br />Ordinance #986. The proposed uses shown on the <br />Schempp General Development Plan are Residential <br />and Commercial/Office. Public use land dedication <br />includes open space buffer, "gateway" area at <br />South Boulder Road, lake-oriented open space and <br />Hecla Lake property (at one-half credit). The <br />Development Agreement and a deed for South Boulder <br />Road right-of-way have also been submitted. <br />Planning Commission reviewed this request and <br />recommends approval. <br />Mohr moved and Scarpella seconded that Council <br />approve the General Development Plan for the Pow <br />Wow Grounds. By Roll Call vote, the motion passed <br />5-1-1 with Sackett voting no and Anderson <br />abstaining. <br />Anderson rejoined the meeting. <br />ORDINANCE #990, SERIES 1989 - RB DEVELOPMENT, INC. WATER RIGHTS PURCHASE <br />AGREEMENT - 2ND READING, <br />PUBLIC HEARING Read by title only Ordinance #990, Series 1989, <br />"An Ordinance approving a contract for the <br />purchase of water rights to be used in the <br />municipal water system and authorizing the <br />issuance of a special obligation water revenue <br />note in payment therefor." Proof of publication <br />and notice of public hearing were established. <br />Williamson stated that Ordinance #990 authorizes <br />approval of the water sale contract and the <br />issuance of the promissory note for South Boulder <br />Canon Ditch shares. The City would pay $6,000 <br />down at closing and pay the remaining $90,000 over <br />several years pursuant to a promissory note <br />bearing interest at the rate of 6$. <br />Mayor Fauson opened the public hearing and asked <br />for any public comments either in favor of or in <br />opposition to Ordinance #990. None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Mohr moved and Mayor Fauson seconded to adopt <br />Ordinance #990, Series 1989. By Roll Call Vote <br />Ordinance #990, Series 1989 was adopted ?-0. <br />Both Anderson and Sackett asked to be excused from action on the next <br />item due to possible conflict of interest. <br />6 <br />
