Paul W. McCowan, 7616 Dyer Road, Louisville, Colorado, was opposed to the annexation and was <br />unhappy with the manner in which it was brought to Council. He felt his rights as a homeowner were <br />being violated in being notified of the proceedings. He had retained a lawyer. He felt Home Depot <br />should not be able to take the 60' fight-of-way, block people in, increase the volume of traffic through <br />his yard, and devaluate his property. <br /> <br />Roy Garvert, 7780 Dyer Road, Louisville, Colorado, was opposed to the annexation and agreed with <br />McCowan's comments. He had voiced his opposition to the annexation at the Planning Commission <br />meeting on September 12. At this time the Planning Commission instructed Home Depot to come <br />with a solution that was agreeable with all of the property owners in Sterling Heights Subdivision as <br />to access from the east to Sterling Heights Subdivision. This had not been done to date. He asked <br />Council to delay their final approval of this until this gets settled and proper access is granted. <br /> <br />Davidson called for anyone else wishing to speak on Ordinance No. 1198. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council questions and comments. <br /> <br />Mayer asked if there was any problem with the City's due process with this annexation. <br /> <br />Susan Griffiths, City Attorney, was not aware of any problem. <br /> <br />Sisk asked if the property being annexed was in agreement with Section 31.12.104 & 105. <br /> <br />Wood stated that it was. <br /> <br />Sisk moved that Council adopt Ordinance No. 1198, Series 1995, on second and final reading and <br />hearing. Seconded by Levihn. Roll call was taken. Motion passed by a 5 - 0 vote with Lathrop and <br />Howard being absent. <br /> <br /> 2.) ORDINANCE NO. 1199, SERIES 1995 - AMENDING TITLE 17 OF THE <br /> LOUISVILLE MUNICIPAL CODE ENTITLED "ZONING" BY ZONING <br /> PROPERTY ANNEXED BY THE STERLING ANNEXATION - 2ND <br /> READING (PUBL. LSVL. TIMES 8/19/95) <br /> <br />Griffiths read by title only Ordinance No. 1199, Series 1995, "An ordinance amending Title 17 of the <br />Louisville Municipal Code entitled "Zoning" by zoning property annexed by the Sterling Annexation." <br /> <br />Paul Wood, Planning Director, stated this ordinance will zone the annexed 1.15 acre parcel to <br />Commercial Business (CB). <br /> <br />Davidson opened the public hearing calling for anyone wishing to speak on Ordinance No. 1199. <br /> <br /> <br />
