NONE <br /> <br />Davidson closed the public hearing and called for Council comments, questions, or motions. <br /> <br />Sisk moved that Council adopt Ordinance No. 1199, Series 1995, on second and final reading. <br />Seconded by Keany. Roll call was taken. Motion passed by a 5 - 0 vote with Howard and Lathrop <br />being absent. <br /> <br />3.) <br /> <br />ORDINANCE NO. 1202, SERIES 1995 - VACATING A PORTION OF <br />STERLING HEIGHTS SUBDIVISION LOCATED IN THE SOUTHEAST <br />QUARTER OF SECTION 13, TOWNSHIP 1 SOUTH, RANGE 70 WEST, <br />SIXTH PRINCIPAL MERIDIAN, BOULDER COUNTY, COLORADO, <br />WITHIN THE CITY OF LOUISVILLE - 2ND READING - PUBLIC <br />HEARING (PUBL. LSVL. TIMES 9/23/95) <br /> <br />Griffiths read by title only Ordinance No. 1202, Series 1995, "An ordinance vacating a portion of <br />Stealing Heights Subdivision located in the southeast quarter of Section 13, Township 1 south, Range <br />70 west, Sixth principal meridian, Boulder County, Colorado, within the City of Louisville." <br /> <br />Paul Wood, Planning Director, stated that this is in conjunction with the proposed site development <br />plans for Home Depot. The proposed vacation of the 60' wide right-of-way in Sterling Heights <br />Subdivision follows in sequence behind the annexation of the Sterling Heights right-of-way. A 30' <br />wide utility and emergency fire lane access easement had been dedicated by the subdivision plat across <br />the width of the former right-of-way. This will be a second means of emergency access to Sterling <br />Heights at such time that the Sterling Heights right-of-way is improved. Planning Commission <br />approved this on September 12 with one condition: That the vacation shall not take effect prior to <br />the effective date of the annexation ordinance. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on Ordinance No. 1202. <br /> <br />NONE <br /> <br />Davidson closed the public hearing calling for Council comments, questions, or motions. <br /> <br />Mayer asked if this provides for the emergency access. <br /> <br />Wood stated that it is an emergency access only. It is not anticipated that it would be improved at <br />this time. It goes up to the west property line of what would be Home Depot's property line. <br /> <br />Susan Griffiths, City Attorney, stated for clarification that the reservation for the right-of-way is not <br />included within this ordinance. It would be included on the subdivision plat through the approval <br />of Resolution No. 51. <br /> <br />4 <br /> <br /> <br />
