City Council <br />Meeting Minutes <br />December 21, 2010 <br />Page 7 of 11 <br />ORDINANCE No. 1586 SERIES 2010 — AN ORDINANCE ELIMINATING WARD <br />RESIDENCY REQUIRMENTS FOR MEMBERS OF THE CITIZENS OPEN SPACE <br />ADVISORY BOARD — Public Hearing <br />Mayor Sisk requested a City Attomey introduction. <br />City Attorney Light read Ordinance No. 1586, Series 2010. <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />Public Relations Manager Muth reported during the 2010 board and commission <br />appointment process staff became aware of the provision in Ordinance No. 1329, <br />Series 2000, which states "No more than three members shall be appointed from one <br />Ward." This requirement has not been enforced since the board's creation, nor does the <br />existing board meet the requirement as all current members reside in either Ward I or <br />Ward II. As no other board or commission has a ward residency requirement, the <br />ordinance eliminates the requirement for the Open Space Advisory Board. <br />Mayor Sisk requested public comment and hearing none, closed the public hearing. <br />MOTION: Councilor Muckle moved to approve Ordinance No 1586, Series 2010, on <br />1110 second reading, seconded by Councilor Sackett. Roll call vote was taken. The motion <br />carried by a vote of 7 -0. <br />RESOLUTION No 80, SERIES 2010 — A RESOLUTION APPROVING AN <br />AMENDMENT TO A PREVIOUSLY APPROVED PLANNED UNIT DEVELOPMENT <br />(PUD) PLAN TO ALLOW A DOG DAYCARE AND OVERNIGHT DOG BOARDING <br />CENTER (NOT A VETERINARY CLINIC) IN A BUILDING LOCATED IN THE <br />PLANNED COMMUNITY ZONE DISTRICT — COMMERCIAL (PCZD -C) ZONE <br />DISTRICT (2103 COURTESY ROAD) <br />Mayor Sisk requested a Staff presentation. <br />Planning Director Russ explained the applicant, The Divine Canine, requests approval <br />of an amendment to the existing PUD plan to allow for a dog daycare and ovemight dog <br />boarding center (not a veterinary clinic) in a building located in the planned community <br />zone district commercial (PCZD -C) zone district. This request is to amend the PUD to <br />allow the specific use within the existing buildings currently located on the property - no <br />additional development is requested. The subject property is located at 2103 North <br />Courtesy Road. The use was approved by a Special Review Use in September 2006. <br />The purpose of this submittal is to allow for dog daycare and ovemight boarding use to <br />be included in the existing PCZD -C overlay. The request is for a use change only and <br />411 will not involve any redevelopment or any new structures on this property. They plan to <br />reuse the existing 7,000 square foot building, which is located at the northeast comer of <br />
