Reviewing the neighborhood plots with two city planners revealed that my <br />property is the only one within at least 1000 feet diameter which has two <br />easements running through the property. The slope of my lot, and the number <br />of large established trees on the property are also unique to my property. <br />3) That because of such physical circumstances or conditions, the property cannot <br />reasonably be developed in conformity with the provisions of this title (Louisville <br />zoning code); <br />The combination of the easements, the slope, the narrowness of the lot, the <br />decking, and the number of large established trees makes my proposed work <br />shed location one of the very few places I could build this lot and still be <br />within Louisville code. A 12x12 shed would add only 144sgft of lot coverage to <br />my existing 1680sgft of lot coverage (from the home — 1184sgft, the garage — <br />400sqft, and the only deck in back yard above 30" off ground — 98sqft). <br />Louisville zoning code for this neighborhood stipulates that owners can <br />develop up to 21.3% of the lot coverage, and with my 9604sqft lot, that would <br />equal 2045sgft. My proposed 144sgft would put me at a total of 1824sqft, well <br />below my allowed 2045sgft. <br />4) That such unnecessary hardship has not been created by the applicant; <br />All easements, decking, dwelling structures, yard slopes, and established <br />trees were here when we purchased the property. <br />5) That the variance, if granted, will not alter the essential character of the <br />neighborhood or district in which the property is located, nor substantially or <br />permanently impair the appropriate use or development of adjacent property; <br />I already work out of my home performing these tasks described above. I also <br />travel about 60 -70% of the time, so the office would really only be in use <br />perhaps one week per month. I will only be running electrical (no plumbing, <br />toilets, sinks, etc) to the office, and again, only anticipate daylight hours <br />usage, only for perhaps one week per month. The shed I'm building is a <br />professionally built, aesthetically pleasing office shed built by a company I <br />searched out right here in Louisville (https:llwww.studio- shed.com). They use <br />high quality materials, and overall 1 think this would be an add to the <br />neighborhood, not a subtraction from it. The south facing part of the shed <br />would be all glass, allowing energy efficiency, so I anticipate actual electric <br />usage to be low. l have already purchased the shed, and will be doing a full, <br />legal permit from the city to build it out in accordance with all Louisville <br />zoninig codes. <br />6) That the variance, if granted, is a minimum variance that will afford relief and is <br />the least modification possible of the provisions of this title (Louisville zoning <br />code) which are in question <br />I would have actually liked to build a larger shed (14x14), but am <br />compromising on a smaller one. This would allow me a desk, a couch, and a <br />table to work at. The five foot back fence variance I'm asking for would allow <br />me to build an acceptably sized work shed that I would only be using perhaps <br />one week per month, again during daylight hours. <br />
