i. Governmental Immunity and Liability Limitations. Lessee, its officers, and its employees, <br />are relying on, and do not waive or intend to waive by any provision of this Lease, the <br />monetary limitations (presently $350,000 per person and $990,000) per occurrence) or <br />any other rights, immunities, and protections provided by the GIA, or otherwise available <br />to Lessee and its officers or employees. Similarly, any claim of Lessor by Lessee or its <br />users hereunder, shall be expressly limited to Lessor's interest in the property located at <br />901 and 917 Front Street, Louisville, Co and in no event shall Lessor's officers, directors, <br />managers, members, partners, or employees have any liability to Lessee personally <br />hereunder. <br />J• <br />Rights and Remedies. The rights and remedies of Lessor and Lessee under this Lease <br />are in addition to any other rights and remedies provided by law. The expiration of this <br />Lease shall in no way limit Lessor's or Lessee's legal or equitable remedies, or the <br />period in which such remedies may be asserted. <br />k. Subject to Annual Appropriations. Consistent with Article X, § 20 of the Colorado <br />Constitution, any financial obligations of Lessee not performed during the current fiscal <br />year are subject to annual appropriation, and thus any obligations of Lessee hereunder <br />shall extend only to monies currently appropriated and shall not constitute a mandatory <br />charge, requirement or liability beyond the current fiscal year. In the event the City <br />Council of the Lessee shall, in its sole discretion, determine not to appropriate funds for <br />payment under this Lease, then this Lease shall automatically terminate at the end of the <br />then current fiscal year for which funds for this Lease have been appropriated. Nothing <br />in this provision shall relieve the City of the obligation to pay rent for any period of actual <br />use of the premises. <br />[Remainder of page intentionally left blank - signatures on following page] <br />
