SMITH <br />AsloCiates <br />This latter is to respond briefly to the latter from Ms. <br />Jones and Mr. Adams to you and other City representatives <br />concerning the Hillandala annexation. Tha latter requests two <br />actions of the City: 1) that the City reconsider Ordinance No. <br />987 and 2~ that the ordinance be submitted to a vote. However, <br />the City has already reconsidered the subject ordinance and <br />scheduled a spacial election by its adoption of Resolution No. 15 <br />on May 19, 1989. The requested action is, therefore duplicitous. <br />The statutory sections with respect to referendum petitions <br />contemplate that at the time a referendum petition is filed all <br />approvals have bean obtained and the measure will become <br />effective by the mere passage of time. It is my understanding <br />that on or about May 23, 1989, referendum petitions ware filed <br />with the City Clerk with respect to Ordinance No. 987. However, <br />at that point in time the ordinance had already bean scheduled <br />for a spacial election and therefore did not Nava the necessary <br />approval of the City contemplated by the referendum statute. <br />In my opinion Ordinanc <br />approved by the voters at a <br />the June 5, 1989 letter is <br />process and the Council's <br />election by the adoption of <br />e No. 987 can become effective only if <br />n election and the action requested in <br />inconsistent with both the statutory <br />prior action in setting the special <br />Resolution No. 15. <br />Very rely yours, <br />Stephan T.
