SMITH AsloCiates This latter is to respond briefly to the latter from Ms. Jones and Mr. Adams to you and other City representatives concerning the Hillandala annexation. Tha latter requests two actions of the City: 1) that the City reconsider Ordinance No. 987 and 2~ that the ordinance be submitted to a vote. However, the City has already reconsidered the subject ordinance and scheduled a spacial election by its adoption of Resolution No. 15 on May 19, 1989. The requested action is, therefore duplicitous. The statutory sections with respect to referendum petitions contemplate that at the time a referendum petition is filed all approvals have bean obtained and the measure will become effective by the mere passage of time. It is my understanding that on or about May 23, 1989, referendum petitions ware filed with the City Clerk with respect to Ordinance No. 987. However, at that point in time the ordinance had already bean scheduled for a spacial election and therefore did not Nava the necessary approval of the City contemplated by the referendum statute. In my opinion Ordinanc approved by the voters at a the June 5, 1989 letter is process and the Council's election by the adoption of e No. 987 can become effective only if n election and the action requested in inconsistent with both the statutory prior action in setting the special Resolution No. 15.
