SERIES 1989 Stahl explained that in May, Council set a <br />Special Municipal Election for July 11, 1989, <br />for the Hillandale annexation ordinance. <br />Stahl and the City Attorney were in District <br />Court this week to answer a complaint by <br />James Adams, Barbara Jones, et al. regarding <br />the procedure Council had previously set by <br />calling for a Special Election. The City <br />maintained throughout those discussions that <br />the action previously taken by the Council <br />for reconsidering Ordinance #987 by Special <br />Election was appropriate. However, it became <br />apparent that during the discussions with the <br />complainant, Adams, Jones, et al., and with <br />the Louisville Council that it would be <br />prudent to bring back to the Council the <br />document that would enable the City to <br />continue to move forward with exactly the <br />same ballot question with a time frame that <br />would bring some finality to the issue in a <br />timely manner. <br />Williamson explained that the request was for the <br />Court to instruct the City to accept a referendum <br />petition and combine that requested election with <br />the one that Council had already set for July <br />11th. After discussing that with the counsel for <br />the plaintiffs, it became clear, and they <br />eventually agreed, that the statutes required more <br />notice of referendum election than would be <br />available if the City proceeded with the July 11th <br />Election. The only way to comply with their <br />request and reach some kind of resolution was to <br />agree to a slight delay in the election to comply <br />with statutory requirements for notice. <br />Williamson stated that his office has prepared an <br />agreement which has already been signed by Mr. <br />Miller, attorney for the plaintiffs, in which they <br />would agree to dismiss the lawsuit and waive any <br />rights of appeal to bring some finality to this <br />matter if Council agrees to set the election this <br />evening. The only dates that would meet all the <br />legal requirements would be July 25, August 1 or <br />August 8. The Boulder County Clerk's office has <br />suggested that the City of Louisville hold their <br />election the same day as Broomfield's (August 1} <br />in order to reduce some of the costs by the two <br />cities sharing support costs from the County. <br />Staff has asked that August 1 be considered by <br />Council and has prepared Resolution #16 using that <br />date. <br />Williamson stated the agreement allows the <br />citizens of Louisville to go forward with the <br />3 <br />
