Ferris explained that Ordinance #996 concerns the <br />issuance of a temporary liquor license and the fees <br />to be charged for that license. Senate Bill 113, <br />effective April 27, 1989, provides for local liquor <br />licensing authorities to grant a temporary license <br />to persons who, through negligence or inadvertence, <br />have allowed their liquor licenses to expire without <br />renewing them. This Bill does not change the <br />current law: persons who let their license expire <br />(without renewing them) must still apply for a brand <br />new license. However, SB 113 does permit issuance <br />of a temporary license under certain circumstances: <br />1) he submits an application for a brand new license <br />(including appropriate fees); 2) he submits that new <br />license application within 90 days of the date of <br />his old license expired; 3) he pays the local <br />licensing authority $250 for the temporary license. <br />If the applicant meets these criteria then the local <br />authority must issue the applicant a temporary <br />license which is good until the applicants new <br />permanent license is issued or denied, or it has <br />been more than 4 months since the temporary license <br />was issued (the temporary license itself expires 4 <br />months after it was issued and can not be renewed). <br />This allows the applicant (who formerly had a <br />license) to operate his establishment while the <br />state and local authorities examine his application <br />for a brand new license. This Bill does not include <br />a provision for holder of 3.2$ beer licenses. <br />Williamson explained that the Ordinance is written <br />as the State Bill requires. There is no provision <br />for the licensing authority (Council) to make any <br />revision to the legislation. <br />Anderson moved and Mayor Fauson seconded to place <br />Ordinance #996 out for publication and a public <br />hearing set for September 19, 1989. Motion carried <br />6-0. <br />AWARD OF BID - SOUTH BOULDER ROAD MEDIAN IMPROVEMENTS - <br />PHASE I Phase explained that on August 8th bids were opened <br />for this project. Items included in the work were <br />concrete, irrigation system, and landscaping of two <br />(2) medians between Cottonwood Drive and Centennial <br />Drive on South Boulder Road. Both medians have a <br />combined length of approximately 900 feet with <br />proposed landscaping of 16 trees and 14 shrubs. <br />North Boulder Sprinkler and Landscape Inc. were the <br />low bidders and Phare asked that Council award the <br />contract to them. <br />Mohr moved and Ferrera seconded to award the South <br />Boulder Road Median Improvements Phase I project to <br />North Boulder Sprinkler and Landscape, Inc. in the <br />3 <br />
