as well as the improvements that Louisville <br />contemplated plus some maintenance agreement on the <br />ditch. <br />ADJOURNMENT <br />An alternative to providing a drainageway is to <br />acquire a piece of property adjacent to the Lafayette <br />drainageway and construct a drainage ditch for only <br />that area that is north of So. Boulder Road and west <br />of the drainageway. Staff has had two initial <br />discussions with the property owners, the Mayhoffer <br />Estate representatives, and would like to move <br />forward with the negotiations. <br />In order to do that, staff is asking Council <br />authorization to secure the necessary survey work to <br />determine exactly the size and legal description of <br />the parcel needed for the drainageway. Also, staff <br />needs to acquire an appraisal of the property for a <br />basis to negotiate with the property owners. These <br />two tasks can be accomplished within the current <br />budget allocated for So. Boulder Road -- there is <br />approximately $16,000 that is unencumbered in the <br />project. Subsequent to that, staff would negotiate <br />with the property owner come back to Council with a <br />recommendation to either purchase or if necessary, <br />proceed with eminent domain. <br />Mayor Fauson moved and Mohr seconded to allow staff <br />to proceed with the survey and continue negotiations <br />based on an appraisal and bring back a recommendation <br />to Council. Motion carried 7-0. <br />With no further business, Mayor Fauson adjourned the <br />meeting. <br />11 <br />
