City Council <br />Meeting Minutes <br />May 19, 2015 <br />Page 12 of 34 <br />Council member Lipton asked about the rights of the property owner for redevelopment, <br />should the City decide against purchasing the property. Planning and Building Safety <br />Director Russ explained if the applicant decided to expand their project, they would <br />have to go through a mandatory rezoning. They are currently zoned mixed use <br />residential district and may continue to operate as a residential use. If they came in with <br />a development application, it would be processed as mixed use residential. <br />Council member Lipton asked if the Council declined to purchase this property, it may <br />be quite possible there would not be another opportunity. Planning and Building Safety <br />Director Russ confirmed it is possible the City may not have another opportunity. <br />Council member Leh inquired whether the City could take first right of refusal, if the <br />owner agreed. Economic Development Director DeJong was unsure how the owner <br />would respond and noted they were a willing partner in the sale of the property. If the <br />City does not purchase the property, they may be looking for other ways to develop the <br />property. He could ask the applicant if they were interested in the first right of refusal. <br />Mayor Muckle inquired what could be built on this mixed use residential zoned property. <br />Planning and Building Safety Director Russ explained multi - family units could be built <br />with a Special Review however it would be mostly multi - family with ground floor retail. A <br />single family unit would not be allowed. <br />Mayor Pro Tem Dalton inquired what would happen if the owner decided to redevelop <br />the property and later on the City determined the street was needed. Planning and <br />Building Safety Director Russ explained the City could approach the land owner and <br />offer to purchase the property, but if the owner refused, it could qualify as eminent <br />domain project. It may be a voluntary or non - voluntary acquisition. <br />PUBLIC COMMENTS <br />Samuel Duran,1109 Pine Street, Louisville, CO explained he has lived in the area all his <br />life. He felt this purchase would be a very expensive way to extend Lee Avenue. He <br />did not oppose development as long as it stayed up north. He referred to the 2003 and <br />2013 Framework Plans, which noted the City would not force change or impact the <br />Miner's Field and Little Italy neighborhoods. He agreed with the comments made by <br />other neighbors. He was not aware his street was considered commercial. Planning and <br />Building Safety Director Russ noted the zoning has changed a number of times but is <br />now MUR. <br />Mr. Duran urged Council not to buy the home and extend Lee Avenue. He asked if <br />CDOT had any influence on the Lee Avenue extension. Planning and Building Safety <br />Director Russ explained CDOT developed their plan assuming Lee Avenue would be <br />extended however they do not have control over the development. It is up to the City to <br />decide on a development plan and, its implementation. <br />
